RESOLUTION NO. 2026-0477 (Sponsored by: Honorable Ronald Christopher Glenn L. Ariosa) "A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR TO REVOKE THE DEED OF DONATION PREVIOUSLY EXECUTED IN FAVOR OF THE DEPARTMENT OF AGRARIAN REFORM (DAR)-REGIONAL OFFICE IX OVER LOT 2, BLOCK 4 OF THE PRC-MCO SUBDIVISION PLAN, SITUATED AT THE PRESIDENT CORAZON C. AQUINO REGIONAL GOVERNMENT CENTER, BARANGAY BALINTAWAK, THIS CITY, AS GRANTED UNDER RESOLUTION NO. 2020-0879, FOR FAILURE TO COMPLY WITH THE CONDITIONS OF THE DONATION" WHEREAS, the Sangguniang Panlungsod (13th City Council), during its 63rd Regular Session held on 11 December 2020, enacted Resolution No. 2020-0879 which, in gist, approved the donation of Lot 2, Block 4, containing an area of Five Thousand Five Hundred (5,500) square meters, within the President Corazon C. Aquino Regional Center Site in Barangay Balintawak, this city, to the Department of Agrarian Reform (DAR) as site for its Regional Office and authorizing, for the purpose, Honorable City Mayor Samuel S. Co to sign and execute the Deed of Donation for and in behalf of the City Government of Pagadian. WHEREAS, after several years had elapsed from the time of the execution of the deed, it was revealed that the donee--Department of Agrarian Reform (DAR)--have failed to comply with the requirement to commence the construction of its office building within eighteen (18) months from its execution, which provision is a ground for the revocation of the same for lack of intention on their part of the donee to pursue with the project, hence, the revocation of the same is now most appropriate; NOW, THEREFORE, on seconded motion of Honorable Ronald Christopher Glenn L. Ariosa, be it RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor to revoke the Deed of Donation previously executed in favor of the Department of Agrarian Reform (DAR)-Regional Office-IX (DAR-RIX) over Lot 2, Block 4 of the PRC-MCO Subdivision Plan, situated at the President Corazon C. Aquino Regional Government Center, Barangay Balintawak, this City, as granted under Resolution No. 2020-0879, for failure to comply with the conditions of the donation. RESOLVED FURTHER, to let copies this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his reference and appropriate action, the City Legal Officer; to His Honor, Conrado M. Estrella III, Secretary of the Department of Agrarian Reform, DAR Building, Elliptical Road, Diliman, Quezon City; Engr. Jena C. Salaug, OIC-Regional Director, DAR-Regional Office 9; and all other offices concerned, for their information, guidance and/or appropriate action. APPROVED UNANIMOUSLY.
