"A RESOLUTION REMANDING, WITHOUT ACTION, TO THE BARANGAY COUNCIL OF TUBURAN, THIS CITY, ITS BARANGAY ORDINANCE NO. 01, SERIES OF 2026, ENTITLED: "AN ORDINANCE BANNING DRINKING OF LIQUOR AND INTOXICATING BEVERAGES IN PUBLIC AREAS," WITH ADVISE TO INSTITUTE CORRECTION AND/OR AMENDMENTS ON THE PENAL CLAUSE TO CONFORM WITH SECTION 391 (a)(14) OF THE LOCAL GOVERNMENT CODE OF 1991"

WHEREAS, the Sangguniang Barangay of Tuburan, this city, pursuant to the provisions of Republic Act No. 7160 otherwise known as the "Local Government Code of 1991," transmitted to this august body its Barangay Ordinance No. 01, series of 2026, entitled: "An Ordinance Banning Drinking of Liquor and Intoxicating Beverages in Public Areas," for review;

WHEREAS, the Committees concerned, to which the foregoing matter was jointly referred for initial consideration, recommended that the same be remanded to the concerned Barangay without action to allow the barangay council to amend the penal clause so it aligns with Section 391 (a)(14) of the Local Government Code of 1991 which recommendation merited the unanimous support of the body;

NOW THEREFORE, on seconded motion of Honorable Maphilindo Q. Obaob, be it

RESOLVED to remand, as this body hereby remands, without action, to the Barangay Council of Tuburan this city, Barangay Ordinance No. 01, series of 2026, entitled: "An Ordinance Banning Drinking of Liquor and Intoxicating Beverages in Public Areas," with advise to institute correction and/or amendments on the penal clause to conform with Section 391 (a)(14) of the Local Government Code of 1991." 

RESOLVED FURTHER, to let a copy of this Resolution be transmitted to the Barangay Council of Tuburan, through the Punong Barangay, for their information and guidance.
