"A RESOLUTION AUTHORIZING HONORABLE CITY MAYOR SAMUEL S. CO TO ENTER AND SIGN, FOR AND IN BEHALF OF THE CITY GOVERNMENT OF PAGADIAN, THE MEMORANDUM OF AGREEMENT (MOA), WITH THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR)-REGIONAL OFFICE IX, PURPOSELY TO DO AND PERFORM THE HEREIN SPECIFIED ACTS AND THINGS"
WHEREAS, the Honorable City Mayor forwarded to this august body a copy of draft Memorandum of Agreement (MOA) to be entered into by and between the City Government of Pagadian and the Department of Environment and Natural Resources-Regional Office IX (DENR-RO IX) which, in gist, obligate the concerned parties to do and perform the herein specified acts and things pertaining to the conveyance of real properties for appropriate consideration, with a further request for authority to enter into the same;
WHEREAS, this body, in support of the favorable recommendation of the concerned Committee-to which the matter was referred for initial consideration-and following the incorporation of the necessary provisions in the said MOA which indicated the true intention and desire of both parties, deems it appropriate and in order to clothe the Honorable City Mayor with the necessary authority to enter and sign the said deed, hence, this passage;
NOW THEREFORE, on seconded motion of Honorable Ariel J. Lim, Jr., be it
RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor Samuel S. Co to enter and sign, for and in behalf of the City Government of Pagadian, the Memorandum of Agreement (MOA) with the Department of Environment and Natural Resources (DENR)-Regional Office IX, purposely to do and perform the following acts and things, to wit:
a. The City Government of Pagadian shall, by way of a separate Deed of Donation, convey the Dao Property (Land and Building), particularly described in the MOA, in favor of the DENR-RO IX; and
b. The DENR-RO IX shall, in turn, execute a Deed of Reconveyance and Surrender of Usufruct for the Plaza lots, as specifically described in the MOA, in favor of the City Government of Pagadian.
RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for favorable consideration; to the City Legal Officer; and to the Department of Environment and Natural Resources (DENR)-Regional Office IX, through OIC-Regional Executive Director Marie Angelique C. Go, President Corazon C. Aquino Regional Government Center, Barangay Balintawak, this city, for information, guidance and/or appropriate action.
