RESOLUTION NO. 2026-0366 (Co-Sponsored by: Committee on Transportation, Road Traffic Management & Franchising; Committee on Laws, Rules & Policy Formulation and Committee on Barangay Affairs) "A RESOLUTION REMANDING, WITHOUT ACTION, BARANGAY ORDINANCE NO. 005, SERIES OF 2025, OF THE SANGGUNIANG BARANGAY OF TUBURAN, THIS CITY, ENTITLED: "AN ORDINANCE REGULATING TRAFFIC AND ORDER AROUND THE PREMISES OF PAGADIAN CITY SCIENCE HIGH SCHOOL, TUBURAN CENTRAL ELEMENTARY SCHOOL, PAGADIAN CAPITOL COLLEGE, INC., AND OTHER STRATEGIC AREAS WITHIN BARANGAY TUBURAN, AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF," FOR THE REASON THAT THE REGULATION OF A NATIONAL HIGHWAY FALLS WITHIN THE JURISDICTION OF THE CITY AND NATIONAL AUTHORITIES" WHEREAS, the Sangguniang Barangay of Tuburan, this city, pursuant to the provisions of Republic Act No. 7160 otherwise known as the "Local Government Code of 1991," transmitted to this august body its Barangay Ordinance No. 005, s. 2025, entitled: "An Ordinance Regulating Traffic And Order Around The Premises Of Pagadian City Science High School, Tuburan Central Elementary School, Pagadian Capitol College, Inc., And Other Strategic Areas Within Barangay Tuburan, And Imposing Penalties For Violations Thereof," for review and confirmation; WHEREAS, the Joint Committees on Transportation, Road Traffic Management & Franchising; on Laws, Rules & Policy Formulation and on Barangay Affairs, to which the foregoing concern was referred for initial consideration, recommended that the same be remanded to the concerned Barangay Council on the ground that the regulation of a national highway falls within the jurisdiction of the city and the national authorities; NOW, THEREFORE, on seconded motion of Honorable Bienvenido C. Culve, be it RESOLVED to remand, as this body hereby remands, without action, to the Barangay Council of Tuburan, this city, its Barangay Ordinance No. 005, s. 2025, entitled: "An Ordinance Regulating Traffic And Order Around The Premises Of Pagadian City Science High School, Tuburan Central Elementary School, Pagadian Capitol College, Inc., And Other Strategic Areas Within Barangay Tuburan, And Imposing Penalties For Violations Thereof," for the reason that the regulation of a national highway falls within the jurisdiction of the city and national authorities. RESOLVED FURTHER, to let a copy of this Resolution be transmitted to the Barangay Council of Tuburan through its Punong Barangay, for information, guidance and/or appropriate action.
