CO TO EXECUTE AND SIGN, FOR AND IN BEHALF OF THE CITY GOVERNMENT OF PAGADIAN, THE DEED OF EXCHANGE INVOLVING A CITY GOVERNMENT-OWNED PARCELS OF LAND KNOWN AS LOT NO. 8864-A , PLS-119 (FORMERLY KNOWN AS 5001-A, CSD-12951), CONTAINING AN AREA OF 10,202 SQUARE METERS AND A PORTION OF LOT NO. 5209, PLS-119, CONTAINING AN AREA OF 7,392.73 SQUARE METERS AND THE GSL REALTY CORPORATION INVOLVING THREE (3) PARCELS OF LAND KNOWN AS LOT NO. 5881-B, COVERED BY TRANSFER CERTIFICATE OF TITLE NO. T-26,700, CONTAINING AN AREA OF 5,448 SQUARE METERS, LOT NO. 5881-D, COVERED BY TRANSFER CERTIFICATE OF TITLE NO. T-26,701, CONTAINING AN AREA OF 5,448 SQUARE METERS, AND LOT NO. 5881-F, COVERED BY TRANSFER CERTIFICATE OF TITLE NO. T-26,702, CONTAINING AN AREA OF 5,448 SQUARE METERS, ALL LOCATED AT BARANGAY BALINTAWAK, THIS CITY" WHEREAS, the Sangguniang Panlungsod, during its 63rd Regular Session held on 31 January 2024, enacted Resolution No. 2024-0616 which, in gist, approved the Deed of Exchange to be entered into by and between the City Government of Pagadian involving a parcel of land known as Lot No. 8864-A, Psd-059251, containing an area of 10,202 square meters and the GSL Realty Corporation involving two (2) parcels of land known as Lot No. 5881-B, containing an area of 5,448 square meters and Lot No. 5881-D, Psd-09-09555, containing an area of 5,448 square meters, for a total land area of 10,896 square meters, all located at Barangay Balintawak, this city, and authorizing the Honorable City Mayor to sign the foregoing Deed of Exchange; WHEREAS, upon careful review, both parties have agreed to revise the foregoing Deed of Exchange for which the Honorable City Mayor sought for a new legislative authority to enter into a Deed of Exchange with the GSL Realty Corporation pertaining to a City Government-owned parcels of land particularly described hereunder: Lot No. 8864-A, Pls-119 (formerly known as Lot No. 5001-A, Csd-12951), containing an area 10,202 square meters, situated at Barangay Balintawak, this city--which parcel of land is acquired by the City Government of Pagadian through a Deed of Sale from Ms. Apryl Anne A. Angcon; and A portion of Lot No. 5209, Pls-119, containing an area of 7,392.73 square meters, situated at Barangay Balintawak, this city--which parcel of land is acquired by the City Government of Pagadian through a Deed of Sale from Ms. Dinah Patindol; WHEREAS, while on the part of the GSL Realty Corporation, three (3) parcels of land are the subject of such Deed of Exchange particularly described hereunder: Lot No. 5881-B, covered by Transfer Certificate of Title No. T-26,700, containing an area of 5,448 square meters, situated at Barangay Balintawak, this city; Lot No. 5881-D, covered by Transfer Certificate of Title No. T-26,701, containing an area of 5,448 square meters, situated at Barangay Balintawak, this city; and Lot No. 5881-F, covered by Transfer Certificate of Title No. T-26,702, containing and area of 5,448 square meters, situated at Barangay Balintawak, this city. WHEREAS, this body, in support of the favorable recommendation of the concerned Committees and, finding the same no legal impediment thereto as it is more beneficial to the general interest of the public for use in the expansion of the President Corazon Aquino Regional Government Center site at Barangay Balintawak, this city, deems it appropriate and in order to approve the same, hence, this passage; NOW, THEREFORE, on seconded motion of Honorable Ma. Alicia Elena V. Ariosa, be it RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor Samuel S. Co to execute and sign, for and in behalf of the City Government of Pagadian, the Deed Of Exchange involving a city government-owned parcels of land known as Lot No. 8864-A , PLS-119 (formerly known as 5001-A, CSD-12951), containing an area of 10,202 Square Meters and a portion of Lot No. 5209, PLS-119, containing an area of 7,392.73 Square Meters and the GSL Realty Corporation involving three (3) parcels of land known as Lot No. 5881-B, covered by Transfer Certificate of Title No. T-26,700, containing an area of 5,448 square meters, Lot No. 5881-D, covered by Transfer Certificate of Title No. T-26,701, containing an area of 5,448 square meters, and Lot No. 5881-F, covered by Transfer Certificate of Title No. T-26,702, containing an area OF 5,448 Square Meters, all located at Barangay Balintawak, this city. RESOLVED, FURTHER, to render Resolution No. 2024-0616, dated 31 January 2024, ineffective and inoperative. RESOLVED, FINALLY, to let copies of this Resolution be forwarded to the Honorable City Mayor, for his appropriate action; the City Legal Officer; and the GSL Realty Corporation, through its authorized representative, Ms. Evelyn Garduce, CCPC Compound, Purok 6, Tablon, Cagayan de Oro City, for information, guidance and reference.
