RESOLUTION NO. 2025-0980 (Sponsor: Honorable Jesus B. Bajamunde, Jr.) "A RESOLUTION GRANTING AUTHORITY TO THE HONORABLE CITY MAYOR TO FORMALLY REQUEST THE COMMISSION ON ELECTIONS (COMELEC) FOR THE EXEMPTION OF ALL SOCIAL WELFARE AND SERVICES PROJECTS AS WELL AS HOUSING-RELATED PROJECTS OF THE CITY GOVERNMENT OF PAGADIAN PURSUANT TO RULE IV OF COMELEC RESOLUTION NO. 11060" WHEREAS, in connection with the forthcoming National and Local Elections on 12 May 2025, the Commission on Elections (COMELEC), in line with Section 261(v)(w) of the Omnibus Election Code which, in gist, prohibits the release, disbursement, or expenditure of public funds for Social Welfare and Services Projects within the election period, enacted Resolution No. 11060 which provides the Rules and Regulations on the Prohibition against the Release, Disbursement, or Expenditure of Public Funds for Social Services and Housing-Related Projects, and Issuance of Treasury Warrants and Similar Devices under Sections 261(V) and (W) of the Omnibus Election Code in connection with the May 12, 2025 National and Local Elections, and BARMM Parliamentary Elections; WHEREAS, while the aforementioned Resolution was enacted to protect and uphold the integrity of the electoral process by preventing the misuse of public funds for partisan political purposes, however, Rule IV of the same Resolution provides for an exemption against the said prohibition as a measure to ensure that essential government social services and housing-related projects remains unhampered and unhindered for the benefit and welfare of the general public; WHEREAS, given the foregoing premises, it is but prim and proper to grant the City Chief Executive with the necessary authority to seek an exemption from the Commission on Elections (COMELEC) against the prohibition as enunciated under COMELEC Resolution No. 11060; NOW, THEREFORE, on seconded motion of Honorable Jesus B. Bajamunde, Jr., be it RESOLVED to grant authority, as this body hereby grants authority to the Honorable City Mayor to formally request the Commission on Elections (COMELEC) for the exemption of all Social Welfare and Services Projects as well as Housing-Related Projects of the City Government of Pagadian pursuant to Rule IV of COMELEC Resolution No. 11060. RESOLVED FURTHER, to let copies of this Resolution be transmitted to the Honorable City Mayor Samuel S. Co, for his immediate favorable consideration; to the City Legal Officer; and to the COMELEC Chairman, Honorable George Erwin M. Garcia, Palacio del Gobernador Building, General Luna Street, Intramuros, Manila, through Atty.
