RESOLUTION NO. 2025-0139 (Sponsored by: Committee on Planning & Landed Estates) "A RESOLUTION DENYING THE APPLICATION OF MS. ROSARIO M. TENAJEROS FOR A SPECIAL USE PERMIT FOR THE OPERATION OF A RESORT LOCATED AT BARANGAY DATAGAN, THIS CITY, AND DIRECTING THE OWNER-APPLICANT TO IMMEDIATELY CEASE AND DESIST FROM ENGAGING BUSINESS OPERATIONS THEREAT, WITH A FURTHER ADVICE TO FULLY SETTLE ALL ACCRUED OBLIGATIONS, PENALTIES AND FINES, IF THERE ARE ANY, WITH THE CITY GOVERNMENT OF PAGADIAN, WITHOUT PREJUDICE HOWEVER TO THE RE-APPLICATION UPON COMPLIANCE OF ALL REQUIRED DOCUMENTS AND PERMITS RELATIVE THERETO" WHEREAS, Ms. Rosario M. Tenajeros has submitted to this august body her application for a Special Use Permit for the operation of a resort situated at Barangay Datagan, Pagadian City; WHEREAS, the Committee on Planning and Landed Estates, to which the matter was referred for initial evaluation and investigation, revealed that the applicant has not yet complied with any and all documentary and legal requirements prescribed under existing local zoning ordinances as well as other pertinent laws governing business operations thus constitutes a clear violation of local regulatory policies; WHEREAS, premises considered, this body, after careful perusal, finds it legal and reasonable to deny the said application and to direct the applicant to immediately cease and desist from continuing operation of the establishment until full compliance with all legal and documentary requirements is made; NOW, THEREFORE, on seconded motion of Honorable Ariel J. Lim, Jr., be it RESOLVED to deny, as this body hereby denies the Application of Ms. Rosario M. Tenajeros for Special Use Permit for the operation of a resort located at Barangay Datagan, this city, and further directing the owner-applicant to immediately cease and desist from engaging business operations thereat. RESOLVED FURTHER, advising the owner-applicant to fully settle all accrued obligations, penalties and fines, if there are any, with the City Government of Pagadian, without prejudice however to the re-application upon compliance of all required documents and permits relative thereto. RESOLVED FINALLY, that copies of this Resolution be transmitted to the City Planning & Development Coordinator/OIC-Zoning Administrator; and to the applicant, Ms. Rosario M. Tenajeros, for information, guidance and reference. APPROVED UNANIMOUSLY.
