RESOLUTION NO. 2025-0104 (Sponsored by: Honorable Bienvenido C. Culve) "A RESOLUTION SUSPENDING THE IMPLEMENTATION OF THE MANDATORY CHANGE OF COLOR OF ALL MOTORIZED TRICYCLES-FOR-HIRE OPERATING WITHIN THE CITY OF PAGADIAN, AS REQUIRED UNDER RESOLUTION NO. 2022-1688" WHEREAS, the 13th City Council, in pursuance to Section 157 of City Ordinance No. 2018-400, otherwise known as the "Road Network and Transportation Management Code of Pagadian City," passed Resolution No. 2022-1688 which, in gist, directed the Motorized Tricycle Regulatory Unit (MTRU), through the Honorable City Mayor, to implement Sections 157 and 164 and, in effect, prescribed the color "orange" as the official color for all motorized tricycle for-hire plying within the jurisdiction of the City of Pagadian; WHEREAS, several punong barangays of the city, by way of a joint letter-request addressed to the Sangguniang Panlungsod, sought for the suspension of the afore-mentioned Resolution No. 2022-1688 particularly the implementation of the mandatory change of color of motorized tricycle-for-hire as a requirement for the renewal of franchise citing the concerns from many tricycle operators and drivers over the additional financial burden and inconvenience that has resulted by its enforcement; WHEREAS, finding importance and urgency of the forgoing matter, and after due deliberation and consideration of the merits of the request, this body deems it prudent to suspend momentarily the implementation of Resolution No. 2022-1688 to pave the way the conduct of a comprehensive study and re-evaluation of its provisions; NOW, THEREFORE, on seconded motion of Honorable Bienvenido C. Culve, be it RESOLVED to suspend, as this body hereby suspends the implementation of the mandatory change of color of all motorized tricycles-for-hire operating within the City of Pagadian, as required under Resolution No. 2022-1688. RESOLVED FURTHER, to direct the Motorized Tricycle Regulatory Unit (MTRU) to immediately cease and desist from further implementing the mandatory change of color for all motorized tricycles-for-hire in the city as a pre-requisite for the renewal of franchise. RESOLVED, FINALLY, to let copies of this Resolution be forwarded to the Honorable City Mayor, for his information and appropriate action; the City Legal Office, the Motorized Tricycle Regulatory Unit (MTRU), the President of the Tricycle Operators and Drivers' Associations (TODAs), and all concerned barangays, for information and guidance.
