RESOLUTION NO. 2025-0084 (Sponsor: Hon. Lance Samuel F. Co) "A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR TO EXECUTE AND SIGN THE ADDENDUM TO THE AGREEMENT OF EXCHANGE OF BUILDING ENTERED INTO BY AND BETWEEN THE CITY GOVERNMENT OF PAGADIAN AND THE COOPERATIVE DEVELOPMENT AUTHORITY (CDA), RELATIVE TO THE PROVISION OF ADDITIONAL TERMS AND CONDITIONS TO THE CONTRACTING PARTIES AS HEREIN SPECIFIED" WHEREAS, the Sangguniang Panlungsod (14th City Council), during its 23RD Regular Session held last 01 February 2023, enacted Resolution No. 2023-0189 which, in gist, authorized the Honorable City Mayor to execute and sign the Deed of Exchange of Building to be entered into by and between the City Government of Pagadian, as party of the First Part, and the Cooperative Development Authority (CDA), represented by Regional Director Glenn S. Garcia, as party of the second part, with reference to a Forty Million (P40,000,000.00) Pesos building to be constructed by the City Government over a donated lot in favor of the latter at the President Corazon C. Aquino Regional Government Center at Barangay Balintawak, this City, and a Fifty Million (P50,000,000.00) Pesos building to be constructed by the party of the Second Part over a portion of parcel of land known as Lot No. 2596 (known as city engineer's compound), situated at Barangay San Jose, this City; WHEREAS, after careful perusal of both parties, it was found out that there is a need to provide additional terms and conditions in the original agreement to ensure fairness, equitable and justifiable to both contracting parties, such that a request to execute and sign the said deed is now being sought by the Honorable City Mayor--which request merited the support and concurrence of this august body; NOW, THEREFORE, on seconded motion of Honorable Lance Samuel F. Co, be it RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor to execute and sign the Addendum to the Agreement of Exchange of Building entered into by and between the City Government of Pagadian and the Cooperative Development Authority (CDA), relative to the provision of additional terms and conditions as herein specified, to wit: OBLIGATION OF THE CITY DEVELOPMENT AUTHORITY (CDA): The CDA grants the City Government of Pagadian the right to allow the City Engineer's Office to immediately occupy the San Jose Building; OBLIGATION OF THE CITY GOVERNMENT OF PAGADIAN: Construct the CDA Training Center at the donated lot from the City Government of Pagadian located at the Regional Government Center, Balintawak, Pagadian City; Provide a total budget of Fifty Million Pesos (P50,000,000.00) instead of Forty Million Pesos (P40,000,000.00) for the construction and development of the CDA Training Center, consistent with the amount allocated for the San Jose Building, which budget is allocated as follows: Forty Million Pesos (P40,000,000.00) for construction of the Training Center at RGC, Balintawak, Pagadian City; Ten Million Pesos (P10,000,000.00) for the following additional scope of works: Land Development including land preparation, excavation and embankment; Provision of furniture and fixtures; Provision of 100 KVA Deisel Generator, Air-conditioning Units, and water tank. RESOLVED FURTHER, to let copies of this Resolution be forwarded to the Honorable City Mayor, this city, for his immediate consideration; to the City Legal Office; and to the Cooperative Development Authority, through Undersecretary Alexander B. Raquepo, with Office address at 827 Aurora Boulevard, Immaculate Conception Quezon City, Philippines, for their information. APPROVED UNANIMOUSLY.
