RESOLUTION NO. 2024-0931 (Co-Sponsored by: Committee on Ways & Means, Committee on Laws, Rules & Policy Formulation and Committee on Games, Amusements & Sports) "A RESOLUTION AUTHORIZING THE TEMPORARY UTILIZATION OF THE VACANT CITY GOVERNMENT-OWNED PARCEL OF LAND AT BARANGAY SANTA LUCIA, THIS CITY, AS SITE FOR CARNIVAL RIDES AND SHOWS FROM THE FIRST WEEK OF DECEMBER 2024 UNTIL AFTER CELEBRATION OF THE PASALAMAT FESTIVAL 2025, SUBJECT, HOWEVER, TO THE STRICT ADHERENCE TO SPECIFIC SAFETY, SECURITY AND SANITARY CONDITIONS AND MEASURES STIPULATED HEREUNDER" WHEREAS, in line with the city's customary observance of the Christmas Season and celebration of the Pasalamat Festival come January 21, 2025, the City Government has programmed the staging of various activities to highlight the occasion and one of which will be the operation of a carnival to provide amusement, entertainment and variety shows for the public; WHEREAS, for this purpose, the vacant City Government-owned parcel of land situated at Barangay Santa Lucia, this city, has been proposed and considered as site for the carnival ride and shows starting on the first week of December 2024 until after the celebration of the Pasalamat Festival 2025, such that an authority to utilize the said area has been sought; WHEREAS, this body, after finding no legal impediment thereto, deems it necessary to approve the temporary use of the designated vacant City Government-owned parcel of land at Barangay Santa Lucia as site for carnival rides and shows subject, however, to the specific safety, security and sanitary conditions and measures; NOW, THEREFORE, on seconded motion of Honorable Ann Marjorie N. Revelo, be it RESOLVED to authorize, as this body hereby authorizes the temporary utilization of the vacant City Government-owned parcel of land at Barangay Santa Lucia, this city, as site for carnival rides and shows from the first week of December 2024 until after the celebration of the Pasalamat Festival 2025, subject, however, to the strict implementation of the herein conditions and measures for the best interest of public health, safety and security, to wit: The carnival operator shall, in coordination with the Pagadian City Police Office, install Closed-Circuit Television (CCTV) cameras in strategic locations within the facility; The carnival operator shall provide garbage bins/cans with segregation labels in strategic areas and assign and designate Utility Personnel to oversee the maintenance of cleanliness within the facility and its immediate surroundings; The carnival operator shall provide and install Portable Comfort Rooms (Portalets) and hand washing areas in strategic areas within the facility and ensure proper disposal of the human waste for sanitation purposes; The mechanical and electrical soundness and safety of all the rides available must be thoroughly checked and inspected by the Office of the City Engineer; The carnival operator shall employ Security Guards to ensure the safety and security of the area and its immediate environs for the duration of their temporary occupancy; The carnival operator shall provide and maintain a public information assistance center which must be manned by a trained paramedic who can immediately respond to any and all untoward incidents that might occur thereat; Minors shall be strictly prohibited from placing bets and/or gambling in any of the games inside the carnival; and Non-compliance of the above conditions can be a ground for the revocation of the permit or license to operate. RESOLVED FURTHER, that copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his information and guidance; to the City Engineer, the City Treasurer, the Chief of Police, Pagadian City Police Station; and to all concerned local offices, for guidance and reference particularly in the processing and issuance of local permits.
