RESOLUTION NO. 2024-0921 (Co-Sponsored by: Committee on Police Fire and Public Safety and Committee on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING, WITHOUT ACTION, TO THE BARANGAY COUNCIL OF DITORAY, THIS CITY, ITS BARANGAY ORDINANCE NO. 5, S. 2024, ENTITLED: "AN ORDINANCE IMPLEMENTING CURFEW HOURS FROM 10:00 P.M. TO 4:00 A.M., OF THE FOLLOWING DAY AS "BARANGAY CURFEW HOURS" FOR RESIDENTS OF BARANGAY DITORAY ESPECIALLY STORES, OPERATING BILLIARD, VIDEOKE, KARAOKE MACHINES AND OTHER SIMILAR AMPLIFIED AUDIO SOUND DEVICES WITHIN RESIDENTIAL AREAS AND PROVIDING PENALTIES FOR VIOLATION THEREOF AND FOR OTHER PURPOSES," WITH A RECOMMENDATION TO AMEND AND/OR REVISE THE SAME SO AS TO CONFORM WITH THE PROVISIONS OF THE LOCAL GOVERNMENT CODE" WHEREAS, the Sangguniang Barangay of Ditoray, this city, pursuant to the provisions of Republic Act No. 7160 otherwise known as the "Local Government Code of 1991," transmitted to this august body its Barangay Ordinance No. 5, s. 2024, entitled: "An Ordinance Implementing Curfew Hours From 10:00 P.M. TO 4:00 A.M., Of The Following Day As "Barangay Curfew Hours" For Residents of Barangay Ditoray Especially Stores, Operating Billiard, Videoke, Karaoke Machines and Other Similar Amplified Audio Sound Devices Within Residential Areas and Providing Penalties For Violation Thereof and For Other Purposes," for review and confirmation; WHEREAS, the body, in consideration of the findings of the concerned Committees, to which the foregoing concern was referred for initial consideration, that the foregoing barangay ordinance deems it prim and proper to remand the same to the concerned Barangay Council, without action, for the institution of necessary revisions/amendments to conform with the provisions of the Local Government Code; NOW, THEREFORE, on seconded motion of Honorable Ann Marjorie N. Revelo, be it RESOLVED to remand, as this body hereby remands, without action, to the Barangay Council of Ditoray, this City, its Barangay Ordinance No. 5, s. 2024, entitled: "An Ordinance Implementing Curfew Hours From 10:00 P.M. TO 4:00 A.M., Of The Following Day As "Barangay Curfew Hours" For Residents of Barangay Ditoray Especially Stores, Operating Billiard, Videoke, Karaoke Machines and Other Similar Amplified Audio Sound Devices Within Residential Areas and Providing Penalties For Violation Thereof and For Other Purposes," with a recommendation to amend and/or revise the same so as to conform with the provisions of the Local Government Code. RESOLVED FURTHER, to let a copy of this Resolution be transmitted to the Barangay Council of Ditoray through its Punong Barangay, for information, guidance and/or appropriate action.
