RESOLUTION NO. 2024-0867 (Co-Sponsored by: Committee on Public Utilities, Transportation, Communications & Franchising and Committee on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING, WITHOUT ACTION, TO THE BARANGAY COUNCIL OF BALINTAWAK, THIS CITY, ITS BARANGAY ORDINANCE NO. 06, S. 2024, WITH A FURTHER RECOMMENDATION TO INSTITUTE AMENDMENTS AND/OR MODIFICATIONS THERETO SO AS TO CONFORM WITH THE PROVISIONS OF REPUBLIC ACT NO. 4146, OTHERWISE KNOWN AS THE LAND TRANSPORTATION AND TRAFFIC CODE" WHEREAS, the Sangguniang Barangay of Balintawak, this City, pursuant to the provisions of Republic Act No. 7160 otherwise known as the "Local Government Code of 1991," transmitted to this august body its Barangay Ordinance No. 6, s. 2024, entitled: "An Ordinance Regulating The Control Of Speed Limit To All Drivers Driving Any Kind Or Type Of Vehicles Within The Territorial Jurisdiction Of Barangay Balintawak, City Of Pagadian And Punishing Violators Thereof," for review; WHEREAS, the joint Committees on Public Utilities, Transportation, Communications & Franchising and on Laws, Rules and Policy Formulation, recommended that the same be remanded to the concerned Barangay Council, without action, for the institution of amendments and/or modifications so as to conform with the provisions of Republic Act No. 4146 otherwise known as the "Land Transportation and Traffic Code," particularly the provision which granted authority to confiscate licenses--which recommendation merited the unanimous support of the body; NOW, THEREFORE, on seconded motion of Honorable Monique Shaira Y. To, be it RESOLVED to remand, as this body hereby remands, without action, to the Barangay Council of Balintawak, this city, its Barangay Ordinance No. 06, s. 2024 with a further recommendation to institute amendments and/or modifications thereto so as to conform with the provisions of Republic Act No. 4146, otherwise known as the "Land Transportation and Traffic Code." RESOLVED, FURTHER, to let a copy of this Resolution be transmitted to the Barangay Council of Balintawak through its Punong Barangay, for information, guidance and reference. APPROVED UNANIMOUSLY.
