RESOLUTION NO. 2024-0841 (Sponsor: Committee on Planning and Landed Estates and Committee on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING, WITHOUT ACTION, TO THE HONORABLE CITY MAYOR THE COPY OF THE DEED OF DONATION AND THE REQUEST FOR AUTHORITY TO SIGN AND ACCEPT THE SAID DONATION OF ROAD LOTS & OPEN SPACES AT BRENTWOOD HOMES SUBDIVISION, BARANGAY KAGAWASAN, PAGADIAN CITY, IN FAVOR OF THE CITY GOVERNMENT OF PAGADIAN, WITH A FURTHER ADVISE TO RE-SUBMIT THE SAME ALONG WITH THE FOLLOWING PERTINENT REQUIREMENTS AS SPECIFIED HEREUNDER" WHEREAS, the Honorable City Mayor forwarded to this august body a copy of a Deed of Donation of road lots executed by Mrs. Eleme Mesiona-Tan, registered owner of Brentwood Homes Subdivision, situated at Barangay Kagawasan, this city, in favor of the City Government of Pagadian, with a request for legislative authority to sign and accept the said donation; WHEREAS, upon careful perusal and review, this body, in support of the findings of concerned Committees that the request lacks essential documentary prerequisites, such as titles, technical descriptions, and other legal documents necessary for the acceptance of the donation, deems it in order to remand the same; NOW, THEREFORE, on seconded motion of Honorable Ariel J. Lim, Jr., be it RESOLVED to remand, as this body hereby remands, without action, to the Honorable City Mayor the copy of the Deed of Donation and the request for authority to sign and accept the said Donation of road lots and open spaces at Brentwood Homes Subdivision, situated at Barangay Kagawasan, Pagadian City, in favor of the City Government of Pagadian with a further advise to re-submit the same along with the following requisites, viz: Certificate of Completion (COC) issued by the Department of Human Settlement and Urban Development (DHSUD); Copy of Annotated Titles for the Road Lots and Open Spaces; Clear Specification of the breakdown of the land area in the Deed of Donation; and Proof of organization of the Homeowner's Association in compliance with R.A.9904. RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his information, guidance and/or appropriate action. APPROVED UNANIMOUSLY.
