RESOLUTION NO. 2024-0780 (Co-Sponsors: Committees on Public Utilities, Transportation, Communication s & Franchising and on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING, WITHOUT ACTION, TO THE BARANGAY COUNCIL OF DITORAY, THIS CITY, ITS BARANGAY ORDINANCE NO. 1, S. 2024, WITH AN ADVICE TO INSTITUTE APPROPRIATE AMENDMENTS THERETO, PARTICULARLY ON THE INCLUSION OF A MINIMUM WATER CONSUMPTION AND THE NEED TO EXECUTE A CONTRACT AND/OR AGREEMENT WITH THE PRIVATE LAND-OWNER OF THE WATER SOURCE" WHEREAS, the Sangguniang Barangay of Ditoray, this city, pursuant to the provisions of Republic Act No. 7160 otherwise known as the "Local Government Code of 1991," transmitted to this august body its Barangay Ordinance No. 1, s. 2024, entitled: "A Barangay Ordinance Imposing Monthly Payments/Charges and Penalties on the use of Water Services and Other Matters Regarding Water System of Barangay Ditoray, Pagadian City, Zamboanga del Sur," for review; WHEREAS, upon review of the concerned Committees, to which the foregoing matter was jointly referred for review, recommended to remand the same to ensure the inclusion of a minimum water consumption requirement and the execution of a contract and/or agreement with the private landowner of the water source, to ensure proper management and legal compliance on the water resources utilization, which recommendation merited the unanimous support of the body; NOW, THEREFORE, on seconded motion of Honorable Monique Shaira Y. To, be it RESOLVED to remand, as this body hereby remands, without action, to the Barangay Council of Ditoray, this city, its Barangay Ordinance No. 1, s. 2024, with an advice to institute appropriate amendments thereto, particularly on the inclusion of a minimum water consumption and the need to execute a contract and/or agreement with the private land-owner of the water source. RESOLVED, FURTHER, to let a copy of this Resolution be transmitted to the Barangay Council of Ditoray through its Punong Barangay, for information, guidance and/or appropriate action.
