"A RESOLUTION REQUESTING THE HONORABLE CITY MAYOR TO ALLOCATE APPROPRIATE FUNDS INTENDED FOR THE PAYMENT OF TERMINAL LEAVE BENEFITS OF SEPARATED EMPLOYEES OF THE CITY GOVERNMENT OF PAGADIAN"

WHEREAS, the City Government of Pagadian has always been committed to the promotion and protection of human rights, including the right to just and favorable conditions of work, and the right to an adequate standard of living;

WHEREAS, the City Government of Pagadian values the rights of its employees, including their right to receive just compensation for their services rendered;

WHEREAS, the terminal leave benefit is a rightful entitlement of every employee who has separated from the City Government of Pagadian due to retirement, resignation, or termination of employment;
WHEREAS, Section 37 of Civil Service Commission (CSC) Resolution No. 98-3142 clearly states that any official/employee of the government who retires, voluntarily resigns, or is separated from the service through no fault of his own, and who is not otherwise covered by special law, shall be entitled to the commutation of his leave credits exclusive of Saturdays, Sundays and Holidays without limitation and regardless of the period when the credits were earned;
WHEREAS, based on Supreme Court Ruling in a number of cases stating that government employee's terminal leave benefit is actually the money value of the employees accumulated leave credits; an accumulation of which is intended for old age or separation from service; and that it is a mere bounty given by the government in consideration or in recognition of meritorious services and springs from the appreciation and graciousness of the government;
WHEREAS, it is the responsibility of the city government to ensure that these benefits are paid in a timely manner to those who have rightfully earned them;
WHEREAS, the lack of appropriate funds allocated for the payment of these benefits has resulted in undue delays in the release of said benefits;
WHEREAS, there are currently separated employees of the City Government of Pagadian who have yet to receive their rightful terminal leave benefits due to the lack of appropriate funds, hence, this request;
NOW, THEREFORE, on seconded motion of Honorable Ariel J. Lim, Jr., be it
RESOLVED to request, that this august body hereby requests the Honorable City Mayor to allocate appropriate funds intended for the payment of terminal leave benefits of separated employees of the City Government of Pagadian.
RESOLVED FURTHER, to let a copy of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his favorable consideration.
