RESOLUTION NO. 2023-0232 (Sponsor: Committee on Public Utilities, Transportation, Communications and Franchising) "A RESOLUTION REQUESTING THE HONORABLE SECRETARY OF THE DEPARTMENT OF ENERGY (DOE) TO PROVIDE NECESSARY ASSISTANCE TO THE CITY GOVERNMENT OF PAGADIAN, THROUGH THE COMMITTEE ON PUBLIC UTILITIES, TRANSPORTATION, COMMUNICATIONS AND FRANCHISING OF THE SANGGUNIANG PANLUNGSOD, PERTAINING TO THE CONDUCT OF A RESEARCH REGARDING THE LEGALITY AND PROPRIETY OF GRANTING AUTHORITY FOR THE OPERATION OF TECHNOLOGY SOLUTION RETAIL OUTLETS (TSRO) IN THE CITY OF PAGADIAN VIS-A-VIS THE DEPARTMENT OF ENERGY DEPARTMENT CIRCULAR NO. 2017-11-0011, ENTITLED: "PROMULGATING A REVISED RULES AND REGULATIONS GOVERNING THE BUSINESS OF RETAILING LIQUID FUELS"" WHEREAS, this body was furnished with the legal opinion from the Office of the City Legal Officer regarding the application for business permit of Mr. Gether Palisbo Abo-abo for the establishment and operation of a micro gasoline station or Technology Solution Retail Outlet (TSRO), which, in gist, disallowed the application for lack of an enabling ordinance that shall provide guidelines in the construction, storage, handling and use of flammable and combustible liquids for TSRO pursuant to DILG Memorandum Circular No. 2022-011, dated 07 February 2022 vis-a-vis Department of Energy Department Circular No. 1998-03-004, dated 11 March 1998; WHEREAS, in consideration of the foregoing legal opinion, the body, in view of the findings of the concerned Committee-to which the matter was initially referred-regarding the effects of TSRO to the health and safety of both the consumer and the retailer as well as the means of ascertaining whether the source and quality of the fuel being sold in the market is compliant to the prescribed standards of the Department of Energy, finds it prim and proper to seek the necessary assistance from the Department of Energy relative to the matter in aid of legislation; NOW, THEREFORE, on seconded motion of Honorable Sam Tyra F. Co, be it RESOLVED to request, as this body hereby requests the Honorable Secretary of the Department of Energy (DOE) to provide necessary assistance to the City Government of Pagadian, through the Committee on Public Utilities, Transportation, Communications and Franchising of the Sangguniang Panlungsod, pertaining to the conduct of a research regarding the legality and propriety of granting authority for the operation of Technology Solution Retail Outlets (TSRO) in the City of Pagadian vis-a-vis the Department of Energy Department Circular No. 2017-11-0011, entitled: "Promulgating A Revised Rules and Regulations Governing the Business of Retailing Liquid Fuels." RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, Secretary Raphael Perpetuo M. Lotilla, Department of Energy, Energy Center, 34th St., Rizal Drive, Bonifacio Global City, Taguig City, for information and favorable consideration; and to Honorable City Mayor Samuel S.
