RESOLUTION NO. 2023-0189 (Sponsor: Committee on Planning and landed Estates) "A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR TO EXECUTE AND SIGN THE DEED OF EXCHANGE OF BUILDING TO BE ENTERED INTO BY AND BETWEEN THE CITY GOVERNMENT OF PAGADIAN, AS PARTY OF THE FIRT PART, AND THE COOPERATIVE DEVELOPMENT AUTHORITY (CDA), REPRESENTED BY REGIONAL DIRECTOR GLENN S. GARCIA, AS PARTY OF THE SECOND PART, WITH REFERENCE TO A FORTY MILLION (P40,000,000.00) PESOS BUILDING TO BE CONSTRUCTED BY THE CITY GOVERNMENT OVER A DONATED LOT IN FAVOR OF THE LATTER AT THE PRESIDENT CORAZON C. AQUINO REGIONAL GOVERNMENT CENTER AT BARANGAY BALINTAWAK, THIS CITY, AND A FIFTY MILLION (P50,000,000.00) PESOS BUILDING TO BE CONSTRUCTED BY THE PARTY OF THE SECOND PART OVER A PORTION OF PARCEL OF LAND KNOWN AS LOT NO. 2596 (KNOWN AS CITY ENGINEER'S COMPOUND), SITUATED AT BARANGAY SAN JOSE, THIS CITY" WHEREAS, the Cooperative Development Authority (CDA), being the Usufructuary of a portion of a City Government-owned lot known as Lot No. 2596 (City Engineer's Compound), containing an area of 684 square meters, situated at Barangay San Jose, this city, will construct a building in the said area in the amount of Fifty Million (P50,000,000.00) Pesos for use as its Regional Office IX; WHEREAS, the City Government of Pagadian, on the other hand, will be constructing a building in the amount of Forty Million (P40,000,000.00) Pesos over a donated lot in favor of the Party of the Second Part particularly known as Lot 1, Block 23, containing an area of 3,000 square meters, situated at the President Corazon C. Aquino Regional Government Center site at Barangay Balintawak, this city; WHEREAS, the City Government of Pagadian and the Cooperative Development Authority (CDA) have concertedly agree to execute a Deed of Exchange upon completion of the construction of the building of the Party of the First Part at the President Corazon C. Aquino Regional Government Center at Barangay Balintawak, this city, shall be exchanged with the building constructed by the Party of the Second Part at the City Engineer's Compound, Barangay San Jose, this city; WHEREAS, finding no legal impediment thereto, this body, in conformity with the recommendation of the Committee on Planning and Landed Estates-to which said matter was initially referred-deems it logical and reasonable to clothe the City Chief Executive with the necessary authority to sign the foregoing deed; NOW, THEREFORE, on seconded motion of Honorable Priscilla M. Fernandez, be it RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor to execute and sign the Deed of Exchange to be entered into by and between the City Government of Pagadian, as Party of the First Part, and the Cooperative Development Authority (CDA), represented by Regional Director Glenn S. Garcia, as Party of the Second Part, with reference to a Forty Million (P40,000,000.00) Pesos building to be constructed by the City Government over a donated lot in favor of the latter at the President Corazon C. Aquino Regional Government Center at Barangay Balintawak, this city, and a Fifty Million (P50,000,000.00) Pesos building to be constructed by the Party of the Second Part over a portion of parcel of land known as Lot No. 2596 (known as City Engineer's Compound), situated at Barangay San Jose, this city. RESOLVED FURTHER, to let copies of this Resolution be forwarded to the Honorable City Mayor, this city, for his appropriate action; to the City Legal Office; and to the Cooperative Development Authority, through Regional Director Glenn S. Garcia, CDA-Regional Office IX, 2/F Bance Building, P. Urro St., San Jose District, Pagadian City, for their information. APPROVED UNANIMOUSLY.
