RESOLUTION NO. 2022-1689

"A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR TO INITIATE AND/OR FILE LEGAL ACTION AGAINST REGIONAL DIRECTORS WHO HAVE REFUSED/FAILED TO ABIDE THE ORDER TO TRANSFER THEIR RESPECTIVE REGIONAL OFFICES FROM ZAMBOANGA CITY TO PAGADIAN CITY AS MANDATED UNDER MEMORANDUM CIRCULAR NO. 78"

WHEREAS, on 25 June 2020, His Excellency, President Rodrigo R. Duterte, issued Memorandum Circular No. 78, which, in gist, repealed Memorandum Circular No. 11 (s. 2018), and directed the transfer of regional office of National Government Agencies in Region IX from Zamboanga City to Pagadian City pursuant to Executive Order No. 429 (s. 1990);
WHEREAS, Section 2 thereof mandates and/or orders the remaining regional offices of all departments and agencies of the National Government in Region IX situated in Zamboanga City, or wherever they are currently located, to transfer to Pagadian City, except those of the DTI, DOLE and DOT, which shall remain in Zamboanga City, but shall establish presence in Pagadian City, and such transfer, to be supervised by the NEDA RDC IX in coordination with the City Government of Pagadian, must be completed within two (2) years from the effectivity of the said Memorandum Circular; 
WHEREAS, although several agencies of the national government have already effected the transfer of their regional offices to Pagadian City, however, there are still quite a number of regional government agencies who have deliberately refused/failed to abide the foregoing directive, as the period to comply was specifically set until June 25, 2022, which period had already lapsed;
WHEREAS, the deliberate refusal/failure to abide with the said directive by some Regional Directors in not effecting the transfer of their regional offices is prejudicial and detrimental to the interest of the general public as well as to the delivery of basic services more particularly in this part of the region, hence, authorizing the City Chief Executive to initiate and/or file legal action is imperatively necessary to compel the remaining government regional agencies in the region to expedite their transfer by all legal means;
NOW, THEREFORE, on seconded motion of Honorable Fernando Y. Pameron, be it
RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor to initiate and/or file legal action against regional directors who have refused/failed to abide the order to transfer their respective Regional Offices from Zamboanga City to Pagadian City as mandated under Memorandum Circular No. 78. 
RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his immediate favorable consideration; to the Executive Director, Pagadian Regional Center Management and Coordinating Office, the City Legal Officer, and all other offices concerned, for their information, guidance and reference.
