RESOLUTION NO. 2022-1501

"A RESOLUTION EXTENDING UNTIL FEBRUARY 28, 2022, THE GRANT OF AMNESTY TO ALL DELINQUENT STALL OWNERS OF RENT-TO-OWN SPACES/STALLS AT THE CITY COMMERCIAL CENTER (C3) PARTICULARLY ON THE PAYMENT OF THE ACCUMULATED THREE PERCENT (3%) PENALTY INCURRED FROM UNPAID INSTALLMENT/BALANCE OF THE SALE OF THE STALLS AS PRESCRIBED UNDER PARAGRAPH (C), SECTION 1 OF ARTICLE VIII (STANDARD TERMS AND CONDITIONS ON THE SALE OF STALL OF C3), OF CITY ORDINANCE NO. 2009-288, PROVIDED, HOWEVER, THAT FAILURE TO PAY THE UNPAID STALL AMORTIZATION BALANCES WITHIN THE PRESCRIBED PERIOD SHALL BE A GROUND FOR THE CITY GOVERNMENT TO AUTOMATICALLY RESCIND THE RENT-TO-OWN CONTRACT AND CANCEL THE AWARD AND DECLARE THE STALL VACANT AND AVAILABLE FOR DISPOSITION TO ANY AND ALL INTERESTED APPLICANT"
WHEREAS, the City Commercial Center (C3) Board, during its board meeting held on 18 January 2022, passed and enacted Resolution No. 010-2022 which, in gist recommended to the Honorable Sangguniang Panlungsod to extend until February 28, 2022 the grant of amnesty to all owners of Rent-To-Own spaces/stalls at the City Commercial Center (C3) particularly on the payment of the accumulated Three Percent (3%) Penalty incurred from unpaid installment/balance of the sale of stalls subject to the condition that failure to settle/pay the overdue unpaid stall amortization balances within the prescribed period shall be a ground for the City Government to automatically rescind the Rent-to-Own Contract and cancel the award and declare said stalls vacant and available for disposition to any and all interested applicant;
WHEREAS, the foregoing recommendation of the C3 Board was anchored on the sincere commitment expressed by some owners of rent-to-own spaces/stalls at the City Commercial Center to fully pay/settle the delinquent amortization balance should the grant of amnesty shall be extended until February 28, 2022;
WHEREAS, in view thereof, this body, finding the request reasonable and within the bound of the law, deems it prim and proper to extend until February 28, 2022 the grant of amnesty provided, however, that failure to pay the unpaid stall amortization balances within the prescribed period shall be a ground for the City Government to automatically rescind the Rent-To-Own Contract and cancel the award and declare the stall vacant and available for disposition to any and all interest applicant;
NOW, THEREFORE, on seconded motion of Honorable Troy B. Asugas, be it
RESOLVED to extend, as this body hereby extends until February 28, 2022 the grant of amnesty to all delinquent stall owners of rent-to-own spaces/stalls at the City Commercial Center (C3) particularly on the payment of the accumulated three percent (3%) penalty incurred from unpaid installment/balance of the sale of the stalls as prescribed under Paragraph (C), Section 1 Of Article VIII (Standard Terms And Conditions On The Sale Of Stall Of C3), of City Ordinance No. 2009-288, provided, however, that failure to pay the unpaid stall amortization balances within the prescribed period shall be a ground for the City Government to automatically rescind the Rent-To-Own Contract and cancel the award and declare the stall vacant and available for disposition to any and all interested applicants.
RESOLVED FURTHER, to let copies of this Resolution be furnished the City Commercial Center (C3) Board through Honorable City Mayor Samuel S. Co, in his concurring capacity as Chairman of the C3 Board; and the Manager-City Commercial Center (C3), for their information, guidance and/or appropriate action.
