RESOLUTION NO. 2022-0092 (Sponsor: Committee on Police, Fire and Public Safety) " A RESOLUTION SUPPORTING THE MEASURE OF LAWMAKERS TO PLACE PROVINCIAL JAILS UNDER THE CONTROL OF BUREAU OF JAIL MANAGEMENT AND PENOLOGY, TO AMEND REPUBLIC ACT NO. 6975 AND REPUBLIC ACT NO. 7610 FOR THAT MATTER, AND TO STRONGLY RECOMMEND THE TRANSFER AND/OR TURN-OVER OF THE SUPERVISION OF THE ZAMBOANGA DEL SUR PROVINCIAL JAIL TO THE BJMP." WHEREAS, Joint search led by PDEA-Zamboanga del Sur at the Provincial Jail located in Barangay San Jose, Pagadian City last May 25, 2021 yielded the confiscation of an estimated 79.91 grams of Methampethamine Hydrocloride locally known as "Shabu" inside the jail compound and resulted in the arrest and subsequent filing of a case for violation of R.A. 9165 against a certain Danilo Bulat-ag Martinito pursuant to an Inquest Resolution issued by the City Prosecution Office; WHEREAS, the Committee on Police, Fire and Public Safety conducted a committee meeting in response to a letter from concerned citizen expressing apprehension on the safety of the City and the accountability of the Provincial Jail management and personnel; WHEREAS, it was disclosed that thirty-eight (38) regular personnel and fourteen (14) job order personnel appointed and/or assigned by the Provincial Governor in the provincial jail have no skills or training pertaining to jail management to include the Provincial Warden at the time of said incident; WHEREAS, while this august body recognizes and acknowledges the combined effort and action shown by the concerned national government agencies, however, it cannot be discounted that the safety and security of the said detention facility is already compromised--which can be attributed accordingly to the lack of appropriate equipment as well as necessary qualifications and training of the personnel manning the said facility who are only employees of the Provincial Government of Zamboanga del Sur; WHEREAS, this body, in consideration of the recommendation of the Committee on Police, Fire and Public Safety, to which the said matter was initially referred, deems it imperatively necessary to transfer and/or turn-over the supervision of the Provincial Jail to the Bureau of Jail Management and Penology (BJMP), hence, this recommendation; NOW, THEREFORE, on seconded motion of Honorable Sam Tyra F. Co, be it RESOLVED to recommend, as this body hereby supports the measure of lawmakers to place provincial jails under the control of Bureau of Jail Management and Penology, to amend Republic Act No. 6975 and Republic Act No. 7610 for that matter, and to strongly recommend the transfer and/or turn-over of the supervision of the Zamboanga del Sur Provincial Jail to the BJMP. RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, Senator Ronald M. dela Rosa, Senate Committee on Public Order and Dangerous Drugs, Governor Victor J. Yu, Province of Zamboanga del Sur, for information and in aid of legislation; the Honorable City Mayor Samuel S. Co, and the City Legal Officer, Atty. Georgina L.
