CO TO ENTER AND SIGN THE DEED OF EXTRA-JUDICIAL SETTLEMENT WITH EXCHANGE OF REAL PROPERTY INVOLVING PORTION OF LOT NO. 1-C-1-A, PSD-09-068639, OWNED BY MR. ALFREDO PUERTO AND THE HEIRS OF THE LATE APOLINARIA YAMID-PUERTO, CONTAINING AN AREA OF 10,001 SQUARE METERS, WITH THE CITY GOVERNMENT-OWNED PARCEL OF LAND KNOWN AS LOT NO. 5245-F-1 OF THE SUBDIVISION PLAN, PSD-09-017218, CONTAINNG AN AREA OF 10,001 SQUARE METERS, BOTH SITUATED AT BARANGAY BALINTAWAK, THIS CITY" WHEREAS, Mr. Alfredo Puerto and the late Apolinaria Yamid-Puerto is the registered owner of a parcel of land known as Lot No. 1-C-1-A, Psd-09-068639, covered by Transfer Certificate of Title No. T-47,992, containing an area of 11,169 square meters, situated at Barangay Balintawak, this city, for which upon the demise of Apolinaria Yamid-Puerto, her heirs have formally settled among themselves her conjugal share over Lot No. 1-C-1-A, Psd-09-068639; WHEREAS, along with this, Mr. Alfredo Puerto and the heirs of the late Apolinaria Yamid-Puerto have mutually agreed to exchange a 10,001 square meter portion of Lot No. 1-C-1-A, Psd-09-068639 with the parcel of land owned by City Government of Pagadian known as Lot No. 5245-F-1 of the subdivision plan, Psd-09-017218, registered in the name of Ludy Apao and declared for taxation purposes in the name of the City Government of Pagadian under Tax Declaration No. 2019-000559 and Property Index No. 159-2003-025-2003-192, containing an area 10,001 square meters, situated at Barangay Balintawak, this city; WHEREAS, it is further agreed that the City Government of Pagadian will shoulder all expenses relative to the exchange of the properties stipulated herein; WHEREAS, upon careful perusal and evaluation, this body, following the favorable recommendation of the concerned Committees-to which the foregoing matter was initially referred-and finding no legal impediment thereto, finds it prim and proper to clothe the Honorable City Mayor with the necessary authority to execute and sign the foregoing deed; NOW, THEREFORE, on motion of Honorable Monique Shaira Y. To, duly seconded, it was RESOLVED to authorize, as this body hereby authorizes Honorable City Mayor Samuel S. Co to enter and sign the Deed of Extra-Judicial Settlement with Exchange of Real Property involving portion of Lot No. 1-C-1-A, Psd-09-068639, owned by Mr. Alfredo Puerto and the heirs of the late Apolinaria Yamid-Puerto, containing an area of 10,001 square meters, with the City Government-owned parcel of land known as Lot No. 5245-F-1 of the subdivision plan, Psd-09-017218, containing an area of 10,001 square meters, both situated at Barangay Balintawak, this city. RESOLVED FURTHER, to let a copy of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co; and to the City Legal Officer, for their information, guidance and appropriate action.
