RESOLUTION NO. 2022-0006 (Sponsor: Honorable Sam Tyra F. Co) "A RESOLUTION EARNESTLY REQUESTING HIS EXCELLENCY, PRESIDENT FERDINAND R. MARCOS, JR., TO FAVORABLY CONSIDER THE ISSUANCE OF AN ORDER OR INSTITUTE APPROPRIATE MEASURES THAT WILL EXPEDITE THE TRANSFER/RELOCATION OF THE REMAINING LESS THAN TEN PERCENT (10%) REGIONAL OFFICES OF THE NATIONAL GOVERNMENT AGENCIES FROM ZAMBOANGA CITY TO PAGADIAN CITY" WHEREAS, envisioned to stimulate and spur countryside development as well as establish the presence of government regional offices in the most accessible locations, the late President Corazon C. Aquino issued Executive Order No. 429, dated 12 October 1990, which, in gist, provides for the reorganization of the Administrative Regions in Mindanao and for other purposes, and, in effect, designated the City of Pagadian as the Regional Seat of Government in Region IX--where the designation was strongly supported by the other local government units in the region considering it is more beneficial and advantageous due to its geographical location which is the center of the region; WHEREAS, expectedly, the legality of the Order was challenged by the City Government of Zamboanga and the regional officials then, however, the Supreme Court, in an en banc decision dated 22 June 1995, upheld and decided with finality the legality of the Order; WHEREAS, in view thereof, the designation of Pagadian City as the Regional Seat of Government in Region IX was recognized and supported by the past national government administrations including, among others, former President Gloria Macapagal-Arroyo who subsequently issued Memorandum Circular No. 75, dated 12 November 2004, and recently the issuance by then President Rodrigo R. Duterte of Memorandum Circular No. 78, entitled: "Repealing Memorandum Circular No. 10 (s. 2010), and directing the transfer of regional office of National Government Agencies in Region IX from Zamboanga City to Pagadian City pursuant to Executive Order No. 429 (s. 1990); WHEREAS, consequently, the City Government of Pagadian has already spent more than One Billion (P1,000,000,000.00) Pesos for the purpose of effecting the transfer such as, but not limited to, (a) Purchase of lot for donation to transferring regional offices; (b) Infrastructure Development; (c) Provision of Water & Electricity connection; (d) Concreting of Roads; and (e) Payment of Building Rentals for two (2) years, among others; WHEREAS, furthermore, the plight and inconvenience of the less than Ten Percent (10%) of the remaining regional offices' employees cannot surpass the plight, interest and convenience of the constituencies of the entire Region IX due to the apparent proximity and distance of Pagadian City which is geographically located at the center of the entire region ix and, considering also that the said Order to transfer is thirty-two (32) years old; WHEREAS, although at present several regional offices of the national government in Region 9 have already effected their transfer to Pagadian City where they already constructed and permanently established their respective regional offices, it is unfortunate to note that there are less than Ten Percent (10%) of regional offices in Region IX who have opted to defy the foregoing Orders for one reason or another such that the issuance of a specific and clear instructional document mandating their immediate transfer to Pagadian City by no less than the President of the Republic of the Philippines is imperatively necessary; NOW, THEREFORE, on seconded motion of Honorable Sam Tyra F. Co, be it RESOLVED to earnestly request, as it is hereby earnestly requested, His Excellency, President Ferdinand R. Marcos, Jr., to favorably consider the issuance of an order or institute appropriate measures that will expedite the transfer/relocation of the rest of the Regional Offices of the National Government in Region IX to Pagadian City; RESOLVED, FURTHER, to let copies of this Resolution be furnished His Excellency, President Ferdinand R. Marcos, Jr., Malacanang, Manila, for preferential consideration and favorable action; to Honorable Executive Secretary Victor D. Rodriguez, Malacanang, Manila; and to Honorable Samuel S.
