RESOLUTION NO. 2021-1251 (Sponsor: Honorable Fernando Y. Pameron) "A RESOLUTION APPROVING THE CONDONATION OF ALL ACCUMULATED PENALTIES INCURRED BY ALL STALL OWNERS OF THE CITY COMMERCIAL CENTER (C3) OUT OF THE IRREGULAR PAYMENT OF THE TWENTY PERCENT (20%) DOWN PAYMENT, TWENTY PERCENT (20%) OCCUPANCY AND/OR MONTHLY AMORTIZATION DUE SUBJECT, HOWEVER, TO THE FOLLOWING STIPULATIONS SPECIFIED HEREUNDER" WHEREAS, the City Commercial Center (C3) Board, during its board meeting held on 11 August 2021, passed and enacted Resolution No. 008-2021, entitled: "A Resolution Recommending to the Honorable Sangguniang Panlungsod to Condone the Penalties for Stallholders Who Have Fully Paid Their Stall/s in the Year 2020 and Backward with no Refund of Whatever Penalties Being Already Paid Thereto;" WHEREAS, the afore-mentioned recommendation was made after members of the C3 stall owners or rent-to-own stallholders have sought clarification relative to the accumulated penalties incurred notwithstanding the fact that their respective stall(s) were already fully paid several years ago which pave the way for some stall owners to receive a Certificate of Ownership; WHEREAS, after careful perusal and evaluation, this body, finding no legal impediment thereto, deems it reasonable and practicable to approve the recommendation of the City Commercial Center (C3) Board, hence, this passage; NOW, THEREFORE, on seconded motion of Honorable Fernando Y. Pameron, be it RESOLVED to approve, as this body hereby approves the condonation of all accumulated penalties incurred by all stall owners of the City Commercial Center (C3) out of the irregular payment of the Twenty Percent (20%) Down Payment, Twenty Percent (20%) Occupancy and/or monthly amortization due subject, however, to the following conditions, to wit: That the condonation of all accumulated penalties incurred may only be availed of by those stall owners whose stall(s) have already been fully paid not later than December 31, 2020; and That any and all penalties already paid can no longer be refunded. RESOLVED FURTHER, to let copies of this Resolution be furnished the City Commercial Center (C3) Board through Honorable City Mayor Samuel S. Co, in his concurring capacity as Chairman of the C3 Board; and Mr. Antonio P. Almonte, Jr., C3 Manager/C3 Board Secretariat, for their information, guidance and/or appropriate action.
