"A RESOLUTION APPROVING THE GRANT OF AMNESTY TO ALL STALL OWNERS OF THE CITY COMMERCIAL CENTER (C3) PARTICULARLY ON THE PAYMENT OF THE ACCUMULATED THREE PERCENT (3%) PENALTY INCURRED FROM UNPAID INSTALLMENT/BALANCE OF THE SALE OF THE STALLS AS PRESCRIBED UNDER PARAGRAPH (C), SECTION 1 OF ARTICLE VIII (STANDARD TERMS AND CONDITIONS ON THE SALE OF STALL OF C3), OF CITY ORDINANCE NO. 2009-288, SUBJECT TO THE FOLLOWING GUIDELINES SPECIFIED HEREUNDER" 

WHEREAS, the City Commercial Center (C3) Board, during its board meeting held on 28 May 2021, passed and enacted Resolution No. 007-2021, entitled: "A resolution recommending to the Honorable Sangguniang Panlungsod that all delinquent rent-to-own stallholders be granted an amnesty that, if the total unpaid balance of their stall will be paid within the month of July 2021 to August 2021, the penalty to be paid is Ten Percent (10%) of the total accumulated penalty charged, and if paid within the month of September 2021 to October 2021, the penalty to be paid is Twenty Percent (20%) of the total accumulated penalty charged, and after all when not fully paid, the rent-to-own stalls concerned will be automatically foreclosed and converted to lease while upholding the principle on the "Right to First Refusal" for the lease;" 

WHEREAS, the foregoing recommendation was anchored on the request of all owners of rent-to-own spaces/stalls at the City Commercial Center (C3) due to the adverse effect brought about by the COVID-19 pandemic which have greatly affected the sales and income of their businesses for which they find difficult to sustain and bear the accumulated three percent (3%) penalty per month for every failure to pay the monthly amortization; 

 WHEREAS, this body, in consideration of the provisions under Paragraph (a) of Article 107 of the Rules and Regulations Implementing the Local Government Code of 1991 which provides that matters relating to proprietary functions and to private concerns shall be acted upon by resolution, and after finding the request will not, in any way, compromise the expected revenues derived therefrom nor hamper the smooth operation of the C3 as an economic enterprise, deems it practicable and reasonable to grant the amnesty; 

 NOW, THEREFORE, on seconded motion of Honorable Teodoro M. Quicoy, be it
RESOLVED to approve, as this body hereby approves to grant amnesty to all stall owners of the City Commercial Center (C3) particularly on the payment of the accumulated three percent (3%) penalty incurred from unpaid installments/balance of the sale of stalls as prescribed under Paragraph (c), Section 1 of Article VIII (Standard Terms and Conditions on the Sale of Stall of C3), of City Ordinance No. 2009-288, subject to the following guidelines specified hereunder, to wit: 

The amnesty granted on the accumulated three percent (3%) penalty incurred may be availed of by the stall owners based on the following period with its equivalent percentage of amnesty/reduction, viz:

When the total unpaid balance shall
be paid from July 2021 to August 2021 Only 10% of the total accumulated penalty charged shall be paid
When the total unpaid balance shall
be paid from September 2021 to 
October 2021 Only 20% of the total accumulated penalty charged shall be paid

The qualified C3 stall owners may only avail of the amnesty within the prescribed period specified above.
Failure on the part of C3 stall owners to avail of the amnesty herein granted within the prescribed period shall constrain the City Government of Pagadian to foreclose the concerned rent-to-own space/stall and convert the same into a stall for lease except, however, that the principle on the "Right To First Refusal" shall be upheld for the lease.
RESOLVED, FURTHER, to let copies of this Resolution be furnished the Honorable City Mayor, in his concurring capacity as Chairman-C3 Board; the City Treasurer; the City Auditor; the C3 Manager; and the C3 Stall Owners Association through its President, Dr. Jerelyn de Castro, all of this city, for information, guidance and reference.
