RESOLUTION NO. 2021-0903 (By Acclamation) "A RESOLUTION STRONGLY RECOMMENDING TO THE HONORABLE CITY MAYOR TO MAKE THE NECESSARY REPRESENTATION WITH THE 54 BARANGAY GOVERNMENT UNITS OF PAGADIAN CITY ON THE MATTER OF SETTING A LIMIT/CAP WITH REFERENCE TO THE IMPOSITION AND COLLECTION OF BARANGAY GARBAGE FEE, BUSINESS CLEARANCE FEE AS WELL AS CONSTRUCTION PERMIT FEE IN RELATION TO THE APPLICATION FOR RENEWAL OF BUSINESS PERMIT" WHEREAS, at the onset of another calendar year, the influx of the application for renewal of business permit is most likely foreknown based on the provisions of City Ordinance No. 2017-395 otherwise known as the "Revised Revenue Code of 2017," which states that renewal of business permit/mayor's permit shall be made within the first twenty (20) days of January of each year; WHEREAS, in view of the foregoing, the attention of the City Government has been called on the several complaints from various business owners/proprietors relative to the alleged excessive and exorbitant fees such as, but not limited to, garbage fees and construction clearance fees being imposed by the different barangays of the city which is a pre-requisite for the approval and/or issuance of business/mayor's permit; WHEREAS, while taking cognizance and in recognition of the authority and autonomy of the Barangay Government Units to initiate the collection of local revenues as provided under the Local Government Code of 1991, however, this body, consistent with the thrust and commitment of this present administration to invite and attract potential businessmen and capitalists to invest in the city and, in pursuance to the provisions of Republic Act No. 11032 otherwise known as "The Ease of Doing Business and Efficient Delivery of Government Services," which mandates local government units to make it easier for investors to engage their businesses by reducing the requirement of government clearances and permits, deems it imperatively necessary to institute measures that will regulate and/or set a limit on the imposition and collection of barangay garbage and construction clearance fees to help alleviate the losses incurred by the business sectors, hence this recommendation; NOW, THEREFORE, on unanimous motion of all Council Members present, and severally seconded, it was RESOLVED to strongly recommend, as it is hereby strongly recommended to the Honorable City Mayor to make the necessary representation with the 54 Barangay Government Units of Pagadian City on the matter of setting a limit/cap with reference to the imposition and collection of barangay garbage fee, business clearance fee as well as construction permit fee in relation to the application for renewal of business permit, as herein specified: For Urban Barangays: Garbage Fee Not to exceed P 500.00 Business Clearance Fee Not to exceed P 300.00 Construction Permit Fee Not to exceed P 500.00 For Rural Barangays: Garbage Fee Not to exceed P 300.00 Business Clearance Fee Not to exceed P 200.00 Construction Permit Fee Not to exceed P 200.00 RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S.
