RESOLUTION NO. 2020-0887 (Sponsored by: Honorable Teodoro M. Quicoy) "A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR TO PURCHASE, BY WAY OF A DEED OF ABSOLUTE SALE, PORTIONS OF THE PARCELS OF LAND, CONTAINING AN AGGREGATE LAND AREA OF TWENTY-SEVEN THOUSAND EIGHTY-FOUR (27,084) SQUARE METERS, MORE OR LESS, COVERED BY TRANSFER CERTIFICATE OF TITLE NO. E-1,534, SITUATED AT BARANGAY BALINTAWAK, THIS CITY, IN THE AMOUNT OF NINE MILLION FOUR HUNDRED SEVENTY-NINE THOUSAND FOUR HUNDRED (P9,479,400.00) PESOS FOR THE ACQUISITION/PURCHASE OF ADDITIONAL LOT FOR REGIONAL CENTER, WHICH AREA SHALL BE USED/UTILIZED AS AN ADDITIONAL SITE OF THE PRESIDENT CORAZON C. AQUINO REGIONAL CENTER AND, FOR THE PURPOSE, DECLARING RESOLUTION NO. 2020-0813 INEFFECTIVE AND INVALID" WHEREAS, the Sangguniang Panlungsod (13th City Council), by virtue of Resolution No. 2019-0038, authorizes the Honorable City Mayor to negotiate the purchase of parcels of land, preferably the adjacent lots, for use as additional site of the President Corazon C. Aquino Regional Center at Barangay Balintawak, this City; WHEREAS, in view thereof, the Honorable City Mayor, by way of a letter, informed this body that parcels of land-adjacent to the present Regional Center site-known as portion of Lot Nos. 11, 12, 13, 14, and 15, covered by Transfer Certificate of Title No. E-1,534, containing an aggregate area of Twenty-Seven Thousand Eighty-Four (27,084) square meters, more or less, in reference to Deed of Partition Agreement docketed as Doc. 440, Page 88, Book XXXIX, series of 2019, before Notarial Register of Atty. Maria Theresa Llagas-Oh, is being offered for sale to the City Government in the amount based on the appraised value of P350.00 per square meter set by the City Appraisal Committee through its Resolution No. 06, series of 2020, and for which a request for an authority to purchase the same is being sought by the City Chief Executive; WHEREAS, to ensure the early and successful pursuance of such objective, it is thus imperative to clothe the Honorable City Mayor with the necessary authority to represent the City Government in the formal forging of a Deed of Absolute Sale for the purpose; NOW, THEREFORE, on seconded motion of Honorable Teodoro M. Quicoy, be it RESOLVED to authorize, as this body hereby authorizes the Honorable City Mayor to purchase, by way of a Deed of Absolute Sale, portions of the parcels of land, containing an aggregate area of Twenty-Seven Thousand Eighty-Four (27,084) square meters, covered by Transfer Certificate of Title No. E-1,534, situated at Barangay Balintawak, this city, in the amount of Nine Million Four Hundred Seventy-Nine Thousand Four Hundred (P9,479,400.00) Pesos, which areas shall be used/utilized as an additional site of the President Corazon C. Aquino Regional Center, more particularly known and described as follows, to wit: A portion consist of 7,002 square meters of Lot No. 11 owned by Bambi W. Maghanoy; A portion consist of 7,965 square meters of Lot No. 12 owned by Noli W. Maghanoy; A portion consist of 1,516 square meters of Lot No. 13 owned by Noel W. Maghanoy; A portion consist of 5,844 square meters of Lot No. 14 owned by Mr. Noel W. Maghanoy; and A portion consist of 4,757 square meters of Lot No. 15 owned by Ally W. Maghanoy. RESOLVED, FURTHER, declaring Resolution No. 2020-0813, enacted by the 13th City Council during its 59th Regular Session held on 11 November 2020, ineffective and invalid. RESOLVED, FINALLY, to let a copy of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co; to the City Legal Officer; and to the Executive Director-Pagadian City Regional Center and Management Coordinating Office, for their information, guidance and/or appropriate action.
