ESCOBAR, OIC-CITY LOCAL GOVERNMENT OPERATIONS OFFICER, HIS 1ST INDORSEMENT, DATED 11 NOVEMBER 2020, RELATIVE TO THE LETTER-OPPOSITION/PETITION FILED BY THE CONCERNED RESIDENTS OF BARANGAY BANALE AGAINST MR. RESOLUTION NO. 2020-0817

"A RESOLUTION REMANDING, WITHOUT ACTION, TO MR. FAROUK M. ESCOBAR, OIC-CITY LOCAL GOVERNMENT OPERATIONS OFFICER, HIS 1ST INDORSEMENT, DATED 11 NOVEMBER 2020, RELATIVE TO THE LETTER-OPPOSITION/PETITION FILED BY THE CONCERNED RESIDENTS OF BARANGAY BANALE AGAINST MR. JOSE ELGINALDO C. TABORNO PERTAINING TO THE LATTER'S ALLEGED ACTION TO CLOSE A PRIVATE ROAD LOT, FOR THE REASON THAT THE COURSE OF ACTION REQUIRED CAN BE BEST RESOLVED BY A REGULAR COURT OF LAW" 

WHEREAS, presented for consideration by this august body is the 1st indorsement from Mr. Farouk M. Escobar, OIC-CLGOO, dated 11 November 2020, which is herein quoted en toto, viz:

"Respectfully forwarded to Elkid P. Nakua, Secretary, Sangguniang Panlungsod, Pagadian City, the herein letter complaint from residents of Barangay Banale re: OPPOSITION/PETITION TO MR. JOSE ELGINALDO C. TABORNO ON HIS ACTION OF CLOSURE OF ROAD LOT NO. 5 BETWEEN HIS OCCUPIED LOTS MENTIONED AS LOT NOS. 4,5,7 & 8 OF BLOCK 5 & LOT 1 & 2 OF BLOCK NO. 7 OF THE APPROVED CONSOLIDATION SUBDIVISION PLAN OF LOT 10 & 11 for ANANIAS DIANA." 

WHEREAS, upon careful perusal and evaluation, this body finds such complaint to be best resolved by the court of law, for which remanding the same to the City Local Government Operations Officer, without action, is most appropriate at this prevailing circumstance; 

 NOW, THEREFORE, on seconded motion of Honorable Teodoro M. Quicoy, be it

RESOLVED to remand, as this body hereby remands, without action, to Mr. Farouk M. Escobar, OIC-City Local Government Operations Officer, his 1st indorsement, dated 11 November 2020, relative to the letter-opposition/petition filed by the concerned residents of Barangay Banale against Mr. Jose Elginaldo C. Taborno pertaining to the latter's alleged action to close a private road lot, for the reason that the course of action required can be best resolved by a regular court of law.

RESOLVED FURTHER, to let a copy of this Resolution be transmitted to Mr. Farouk M. Escobar, OIC-CLGOO, this city, for information, guidance and/or appropriate action.
