RESOLUTION NO. 2020-0775 (Sponsored by: Committees on Commerce, Trade and Industry and on Laws, Rules and Policy Formulation) "A RESOLUTION APPROVING THE AMENDMENT/MODIFICATION OF THE PENAL PROVISIONS UNDER SECTION 9 OF CITY ORDINANCE NO. 2020-447 IN COMPLIANCE AND CONFORMITY WITH THE FINDINGS AND RECOMMENDATIONS OF THE SANGGUNIANG PANLALAWIGAN OF ZAMBOANGA DEL SUR, AS ENUNCIATED IN ITS RESOLUTION NO. 882-2020" WHEREAS, this august body enacted City Ordinance No. 2020-447, entitled: "An Ordinance Providing for Comprehensive Guidelines in the Development, Marketing and/or Selling of Subdivision Lots in the City of Pagadian, and Penalizing Developers and Licensed Real Estate Brokers for Violation thereof" and forwarded the same to the Sangguniang Panlalawigan of Zamboanga del Sur, for review and confirmation; WHEREAS, by virtue of Resolution No. 882-2020 of the Sangguniang Panlalawigan of Zamboanga del Sur, the afore-mentioned local legislation was declared valid except the penal provisions under Section 9 thereof for being an ultra vires act, such that appropriate modification thereof is necessary to conform with the powers and authority of the Sangguniang Panlungsod vested under Item (iii), Sub-Paragraph (1), Paragraph (a) of Article 99 of the Rules and Regulations Implementing the Local Government Code of 1991; NOW, THEREFORE, on seconded motion of Honorable Fernando Y. Pameron, be it RESOLVED to approve, as this body hereby approves the amendment/modification of the penal provisions under Section 9 of City Ordinance No. 2020-447 in compliance and conformity with the findings and recommendations of the Sangguniang Panlalawigan of Zamboanga del Sur, as enunciated in its Resolution No. 882-2020.
