RESOLUTION NO. 2020-0734 (Sponsored by: Honorable Teodoro M. Quicoy) "A RESOLUTION GRANTING AUTHORITY TO HONORABLE CITY MAYOR SAMUEL S. CO TO SIGN THE CONFIRMATION OF THE DEED OF EXCHANGE ENTERED INTO BY AND BETWEEN THE CITY GOVERNMENT OF PAGADIAN AND THE HEIR OF TIBURCIA MAYORMITA, INVOLVING THE FOLLOWING PARCELS OF LAND, VIZ: LOT NO. 533 CONTAINING AN AREA OF NINETY-EIGHT THOUSAND FOUR HUNDRED FORTY-ONE (98,441) SQUARE METERS, SITUATED AT BARANGAY BOGO, THIS CITY, AND REGISTERED IN THE NAME OF THE CITY GOVERNMENT OF PAGADIAN; AND LOT NO. 3213-PART CONTAINING AN AREA OF THIRTY-SEVEN THOUSAND FIVE HUNDRED FIFTY-TWO (37,552) SQUARE METERS, SITUATED AT SAN JOSE DISTRICT, THIS CITY, AND REGISTERED IN THE NAME OF TIBURCIA MAYORMITA" WHEREAS, the City Government of Pagadian, by virtue of the authority of the Sangguniang Panlungsod as reflected in the Minutes of their 42nd Regular Session held on 29 October 1991, have entered into an agreement to exchange the City Government-owned parcel of lot known as Lot No. 533 containing an area of 98,441 square meters, situated at Barangay Bogo, this city, with the lot of the heirs of Pajares, represented by the late Joaquin G. Pajares, known as Lot No. 3213-Part containing an area of 37,552 square meters, situated at Barangay San Jose, this city--which lot is still registered in the name of the original owner Tiburcia Mayormita who is already deceased and is survived by her sole heir Flaviano T. Mayormita, Jr.; WHEREAS, following the exchange agreement, the subject Lot No. 3213-Part at Barangay San Jose, this city, had been occupied and used by the City Government of Pagadian and, in fact, as a matter of right and in asserting its ownership over the subject lot, had designated the same for use in educational purposes such as the establishment of the Pagadian City Pilot School, the Department of Education (DEPED) City Division Office and the Tomas Sagun Elementary School; WHEREAS, notwithstanding the above indisputable facts, the records and the documents pertaining to Lot No. 3213-Part remains to be in the name of Tiburcia Mayormita which necessitates that an appropriate conveyance from the Estate of Tiburcia Mayormita be executed in favor of the City Government of Pagadian in order to formalize and for proper documentation of the exchange of the said lot with that of the City Government; WHEREAS, for this reason, there is thus a need for the confirmation of the Deed of Exchange so as to effect the eventual titling of such Lot No. 3213-Part containing an area of 37,552 square meters, situated at Barangay San Jose, this City, in favor of the City Government of Pagadian; WHEREAS, this body, finding no legal impediment thereto and, in the interest of justice and fairness considering that the City Government had already occupied and utilized the lot subject of the exchange for quite so long, deems it logical and reasonable to clothe the City Chief Executive with the authority to sign the confirmation of the Deed of Exchange; NOW, THEREFORE, on seconded motion of Honorable Teodoro M. Quicoy, be it RESOLVED to grant, as this body hereby grants authority to Honorable City Mayor Samuel S. Co to sign the Confirmation of the Deed of Exchange entered into by and between the City Government of Pagadian and the heir of Tiburcia Mayormita, involving the following parcels of land, viz: Lot No. 533 containing an area of Ninety-Eight Thousand Four Hundred Forty-One (98,441) square meters, situated at Barangay Bogo, this city, and registered in the name of the City Government of Pagadian; and Lot No. 3213-part containing an area of Thirty-Seven Thousand Five Hundred Fifty-Two (37,552) square meters, situated at San Jose District, this city, and registered in the name of Tiburcia Mayormita. RESOLVED, FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his information and favorable action; the City Legal Officer; and Mr. Flaviano T.
