RESOLUTION NO. 2020-0650 (Sponsored by: Committee on Public Utilities, Transportation, Communications and Franchising) "A RESOLUTION RECOMMENDING TO THE HONORABLE CITY MAYOR TO CONSIDER THE ACQUISITION AND/OR PROCUREMENT OF A TOWING TRUCK FOR USE IN THE IMPLEMENTATION OF CITY ORDINANCE NO. 2002-215 OTHERWISE KNOWN AS THE "TOWING OF UNSERVICEABLE VEHICLE" IN CONSONANCE WITH THE DIRECTIVE OF THE DILG UNDER MEMORANDUM CIRCULAR NO. 2020-031, OR, IF FOUND ADVANTAGEOUS, NEGOTIATE FOR A CONTRACT OF SERVICES WITH ANY INTERESTED PRIVATE INDIVIDUAL, PARTNERSHIP OR CORPORATION, RELATIVE TO THE TOWING SERVICES IN THE CITY OF PAGADIAN" WHEREAS, the City of Pagadian--considered as one of the fastest growing and developing city in the country--is now experiencing traffic congestions, increased incidents of road accidents and unabated traffic violations due mainly to the unprecedented increase in the number and types of motor vehicles plying the city's thoroughfares in recent years which can be attributed to the increase in population migration, trade and commerce and most significantly the transfer of the Regional Center of the Government to the City; WHEREAS, in view of the foregoing and for the purpose of strengthening and sustaining efforts on clearing roads, alleys and sidewalks for smooth flow of vehicular traffic and for the safety and convenience of the public, the Department of the Interior and Local Government (DILG), issued Memorandum Circular No. 2020-031, which mandates LGUs to establish towed vehicle impounding area for safekeeping of towed vehicles that are illegally parked and stalled vehicles as well as to come up with a clear guideline on towing, impounding and releasing of impounded vehicles; WHEREAS, this body, following the information provided by the concerned Committee-to which the matter was initially referred-that the city has already adopted an enabling ordinance for the purpose known as City Ordinance No. 2002-215 otherwise known as the "Towing of Unserviceable Vehicle," and in order to effectively and efficiently implement the foregoing ordinance in relation to the national government's directive, finds compelling reason to acquire and/or procure towing truck or, if not warranted, shall negotiate with any private individual or entities to engage into towing services through a Contract of Service with the City Government, hence, this recommendation; NOW, THEREFORE, on seconded motion of Honorable Jesuseller M. Duterte, be it RESOLVED to recommend, as this body hereby recommends to the Honorable City Mayor to consider the acquisition and/or procurement of a towing truck for use in the implementation of City Ordinance No. 2002-215 otherwise known as the "Towing Of Unserviceable Vehicle" in consonance with the directive of the DILG under Memorandum Circular No. 2020-031, or, if found advantageous, negotiate for a contract of services with any interested private individual, partnership or corporation, relative to the towing services in the City of Pagadian. RESOLVED FURTHER, to let copy of this Resolution be transmitted to His Honor, City Mayor Samuel S. Co, for his preferential consideration and favorable action. APPROVED UNANIMOUSLY.
