RESOLUTION NO. 2020-0645

"A RESOLUTION APPROVING AND ADOPTING EN TOTO THE RECOMMENDATION OF THE CITY COMMERCIAL CENTER (C3) BOARD AS ENUNCIATED UNDER ITS BOARD RESOLUTION NO. 08, SERIES OF 2020"

WHEREAS, the City Commercial Center (C3) Board, during its Board Meeting held on July 16, 2020, enacted Board Resolution No. 08 Series of 2020, entitled: "A Resolution Recommending to the Honorable Sangguniang Panlungsod to nullify the unlawful 2nd contract on the stalls numbered SF-81, 82 and 85 at the C3 granting the Rent-to Own contract to Mr. Khir Branzuela and returning it to the original owner, Ms. Eunice H. Ong and whatever payments made be credited to Ms. Ong's account, including exemption from the 3% penalty, provided that her balance of P6 million pesos must be paid in full", and forwarded the same to this august body for appropriate consideration;

WHEREAS information revealed that the foregoing action of the Board emanated from the complaint of Ms. Eunice Ong who allegedly been forcibly evicted by the previous administration from occupying and operating Stall Nos. SF-81, 82 and 85 at the second floor of the City Commercial Center (C3)--despite having paid the total amount of P1,218,673.00--and awarded the same stalls through Rent-To-Own Contract, dated May 11, 2015, to a certain Khir Branzuela;
WHEREAS, this body, based on the information provided by the Committee on Ways and Means--to which the matter was initially referred--that the Rent-To-Own Contract entered into by and between the City Government of Pagadian represented by the previous administration and Mr. Khir Branzuela, dated May 11, 2015, is contrary and violative of the provisions under City Ordinance No. 2009-288, entitled: "An Ordinance Establishing the Guidelines and Policies Governing the Operation and Management of the City Commercial Center of the City Government of Pagadian and Imposing Penalties for Violation Thereof," finds it legally reasonable to approve and adopt C3 Board Resolution No. 8, series of 2020; 
NOW, THEREFORE, on seconded motion of Honorable Troy B. Asugas, be it

RESOLVED to approve and adopt, as this body hereby approves and adopts en toto the recommendation of the City Commercial Center (C3) Board as enunciated under its Board Resolution No. 08 series of 2020, as herein stipulated, to wit:

That Stall Numbers SF 81, 82 & 85 at the second floor of the City Commercial Center (C3) be returned or awarded back to Ms. Eunice Ong--being the original awardee of the said stalls; and
That the imposition of the Three Percent (3%) monthly penalty out of the total unpaid monthly amortizations shall be waived by the City Government in the event Ms. Eunice Ong--the original awardee of Stall Numbers SF 81, 82 & 85 at the second floor of the City Commercial Center (C3)--opted to pay in full the total remaining balance of amortizations equivalent to Six Million (P6,000,000.00) Pesos.

RESOLVED FURTHER, to let copies of this Resolution be furnished Honorable City Mayor Samuel S. Co, in his concurring capacity as Chairman of the C3 Board; the Manager-City Commercial Center (C3); and Ms. Eunice Ong, for their information, guidance and reference.
