RESOLUTION NO. 2020-0600 (Sponsored by: Honorable Vincenzo E. Cagampang) "A RESOLUTION REQUESTING THE HONORABLE CITY MAYOR TO DIRECT THE ROAD TRAFFIC AND MANAGEMENT OFFICE (RTMO)-OFFICE OF THE CITY MAYOR, IN CLOSE COORDINATION WITH THE PAGADIAN CITY POLICE OFFICE; ATTN: THE PNP TRAFFIC SECTION, TO STRICTLY ENFORCE THE SPEED RESTRICTION FOR ALL MOTOR VEHICLES, MOTORIZED TRICYCLES AND MOTORCYCLES PLYING IN THE HEREIN IDENTIFIED STREETS OF PAGADIAN CITY AS PROVIDED UNDER SECTION 34 OF CITY ORDINANCE NO. 2018-400 OTHERWISE KNOWN AS THE "ROAD NETWORK AND TRANPORTATION MANAGEMENT CODE OF PAGADIAN CITY" WHEREAS, concerned and alarmed over the series of motorcycle-related crimes in the city as reported by the Pagadian City Police Office particularly the incidents of deadly drive-by shooting and several local incidents of robbery perpetrated by criminal elements who are riding in tandem on motorcycles to easily maneuver so as to abscond and/or evade apprehension from law enforcers; WHEREAS, as a measure to prevent and suppress lawlessness, disorder and criminal acts purposely to maintain peace and order situation of the city, it is thus necessary to strictly implement Section 34 of City Ordinance No. 2018-400, otherwise known as the "Road Network and Transportation Management Code of Pagadian City," which fixed the rate of speed for all motor vehicles, motorized tricycles and motorcycles operating and/or plying in the City of Pagadian, as hereunder quoted as follows: "Section 34. SPEED RESTRICTIONS. - a) No person shall operate, run or drive a vehicle on any street in this city, at rate of speed greater than that permitted by law. b) Subject to the provisions of the preceding paragraph, the rates of speed of vehicles shall under no circumstance exceed the respective values given in the following: Kilometer Trucks, Cars & Motorcycles Per Hour Place: On all streets within the following barangays: 30 Balangasan, Dumagoc, Santo Nino, Gatas, Santa Lucia, Santiago, San Francisco, San Jose, San Pedro Santa Maria, Tuburan, Kawit, Dao, Bulatok, Tiguma, Lenienza, Napolan & Danlugan Upon approaching a pedestrian lane 20 School zones (50 meters from the designated pedestrian lane) within the Poblacion 20 along the Highway 30 The rates of speed above prescribed shall not apply to vehicles under the following situations: A Physician or his driver when the former responds to emergency calls. The driver of a hospital ambulance on the way to and from the place of accident or other emergency. Any driver bringing a wounded or sick person for emergency treatment to a hospital, clinic or any other similar place. The driver of a motor vehicle belonging to the armed forces while in use for official purposes in times of riot, insurrection or invasion. The driver of a vehicle, when he or his passengers, are in pursuit of a criminal. A law enforcement officer who is pursuing a violator of traffic laws. The driver officially operating a motor vehicle of the fire department; Provided, that exemption shall not be construed to allow useless or unnecessary fast driving of drivers aforementioned. NOW, THEREFORE, on seconded motion of Honorable Vincenzo E. Cagampang, be it RESOLVED to request, as this body hereby requested the Honorable City Mayor to direct the Road Traffic and Management Office (RTMO)-Office of the City Mayor, in close coordination with the Pagadian City Police Office; attn: the PNP Traffic Section, to strictly enforce the speed restriction for all motor vehicles, motorized tricycles and motorcycles plying in the herein identified streets of Pagadian City as provided under Section 34 of City Ordinance No. 2018-400 otherwise known as the "Road Network and Transportation Management Code of Pagadian City. RESOLVED, FURTHER, to let copies of this Resolution be furnished His Honor, City Mayor Samuel S. Co, for his preferential attention and favorable action; to the Head-Road Traffic and Management Office, Office of the City Mayor; to P/LT.Col. Alvin P. Saguban, Chief of Police, Pagadian City Police Office, attn: The Head-PNP Traffic Management Section, for their information, guidance and appropriate action. APPROVED UNANIMOUSLY.
