RESOLUTION NO. 2020-0599 (Sponsored by: Honorable Vincenzo E. Cagampang) "A RESOLUTION TEMPORARILY SUSPENDING THE REQUIREMENT ON THE WEARING OF FULL-FACE AND/OR HALF-FACE HELMET INCLUDING THE USE OF NON-TRANSPARENT OR COLORED FACE MASK, TINTED FACE SHIELD, BONNET, CAP, HAT, VISOR, SHADES, EYE PROTECTOR SHIELD AND COLORED EYE GOOGLES, FOR ALL DRIVERS AND RIDERS/PASSENGERS OF MOTORCYCLE WHILE DRIVING WITHIN THE URBAN BARANGAYS OR CITY PROPER OF PAGADIAN CITY, AS PROVIDED UNDER CITY ORDINANCE NO. 2018-416, PURPOSELY TO ENSURE THE FACE OF THE MOTORCYCLE DRIVERS/RIDERS ARE CLEARLY VISIBLE FOR CONVENIENT IDENTIFICATION, EXCEPT SURGICAL FACE MASK/N95/CLOTH MASK" WHEREAS, pursuant to the Local Government Code of 1991, all local government units are mandated to maintain peace and order by enacting measures to prevent and suppress lawlessness, disorder and impose penalties for the violation of said ordinances; WHEREAS, relatedly, to ensure the safety and security of all motorists plying within the territorial jurisdiction of the City of Pagadian, it has been prohibited for all person to operate, run or drive motor vehicle and motorcycle on any street in the city at the rate of speed of 30 kph and 20 kph upon approaching a pedestrian lane and within the city proper pursuant to City Ordinance No. 2018-400, entitled: "An Ordinance Providing for the Road Network and Transportation Management Code of Pagadian City;" WHEREAS, having such speed restrictions, it is safe to note that the use of helmet is somewhat excessive and superfluous with respect to the present situation where there is rise in the cases of motorcycle-related crimes in the city as reported by the Pagadian City Police Office and other local authorities such as deadly drive-by shooting and several local incidents of robbery since the identities of the motorcycle-riding criminals could not be readily ascertained because they are wearing full-face or half-face helmets as well as bonnet, cap, hat, visor, shades, eye protector shield and colored eye googles which render their faces incognito; WHEREAS, such criminal acts perpetrated by criminal elements who are riding in tandem on motorcycles can cause an alarm to the public and is inimical to public order and safety, hence, there is an immediate need to temporarily suspend the provisions of City Ordinance No. 2018-416, so as to ensure the face of the motorcycle drivers and riders/passengers are clearly visible for convenient identification, except the use of surgical face masks to protect against COVID-19 disease, provided, however, that the motorcycle driver and rider/passenger, upon leaving the city proper or urban barangays of the City of Pagadian, shall have to wear or use their respective motorcycle helmet; NOW, THEREFORE, on motion of Honorable Vincenzo E. Cagampang and duly seconded by Honorable Arnold R. Gavenia, it was RESOLVED to temporarily suspend, as this body hereby temporarily suspends the requirement on the wearing of full-face and/or half-face helmet including the use of non-transparent or colored face mask, tinted face shield, bonnet, cap, hat, visor, shades, eye protector shield and colored eye googles, for all drivers and riders/passengers of motorcycle while driving within the urban barangays or city proper of Pagadian City, as provided under City Ordinance No. 2018-416, purposely to ensure the face of the motorcycle drivers/riders are clearly visible for convenient identification, except surgical face mask. RESOLVED, FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co; to the Pagadian City Police Office through the Chief of Police, P/Lt. Col. Alvin P. Saguban; and the Head-Pagadian City Road Traffic and Management Office, Office of the City Mayor, all of this City, for their information, guidance and/or appropriate action. APPROVED UNANIMOUSLY.
