RESOLUTION NO. 2020-0576 (Sponsored by: Committee on Games, Amusements and Sports; and Committee on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING BARANGAY ORDINANCE NO. 2019-01, TO THE BARANGAY COUNCIL OF DAO, THIS CITY, WITHOUT ACTION, WITH AN ADVICE TO IMPLEMENT AND/OR ADOPT INSTEAD CITY ORDINANCE NO. 2019-430 ENTITLED: "AN ORDINANCE ESTABLISHING REGULATION GOVERNING THE OPERATION OF INTERNET SERVICE SITE, JOINTS, CAFES, STATIONS, CENTER OR ANY SIMILAR BUSINESS ENTITIES WITHIN THE TERRITORIAL JURISDICTION OF PAGADIAN CITY BY PROHIBITING PERSONS SEVENTEEN (17) YEARS OLD AND BELOW AND/OR HIGH SCHOOL AND ELEMENTARY STUDENTS, TO USE/OPERATE ITS COMPUTER UNITS DURING SCHOOL HOURS FROM MONDAY TO FRIDAY"" WHEREAS, the Barangay Council of Dao, this City, enacted Barangay Ordinance No. 2019-01, entitled: "An Ordinance Regulating the Operation of Internet Cafe and Pesonet in Barangay Dao Providing Safekeeping Guidelines for Minors and Penalties Thereof" and submitted the same to this body for confirmation; WHEREAS, the Committee on Games, Amusements and Sports and Committee on Laws, Rules and Policy Formulation, to which the same was initially referred for evaluation, submitted its comments and observations that there is an existing City Ordinance No. 2019-430 of the Sangguniang Panlungsod that provides and caters their desired specifications on the said Barangay Ordinance; WHEREAS, it is thus necessary to remand the foregoing Barangay Ordinance with a further advise to implement and/or adopt City Ordinance 2019-430 instead; NOW, THEREFORE, on seconded motion of Honorable Sam Tyra F. Co, be it RESOLVED to remand, as this body hereby remands Barangay Ordinance No. 2019-01, to the Barangay Council of Dao, this city, without action, with an advice to implement and/or adopt instead City Ordinance No. 2019-430 entitled: "An Ordinance Establishing Regulation Governing The Operation of Internet Service Site, Joints, Cafes, Stations, Center or Any Similar Business Entities Within the Territorial Jurisdiction of Pagadian City by Prohibiting Persons Seventeen (17) Years Old and Below and/or High School and Elementary Students, To Use/Operate its Computer Units During School Hours From Monday to Friday." RESOLVED, FURTHER, to let copies of this Resolution be furnished to the Barangay Council of Dao, through its Punong Barangay, for their information, guidance and/or appropriate action.
