RESOLUTION NO. 2020-0541 (Movant: Honorable Arnold R. Gavenia) "A RESOLUTION DECLARING, AS PUBLIC NUISANCE, THE UNUSED FLY OVER/OVERPASS STRUCTURE FRONTING THE PAGADIAN CAPITOL COLLEGE ALONG THE NATIONAL HIGHWAY AT TUBURAN DISTRICT, THIS CITY, AND REQUESTING THE HIGHWAY DISTRICT ENGINEER-FIRST ENGINEERING DISTRICT OF ZAMBOANGA DEL SUR, DPWH, TO COME UP WITH AN APPROPRIATE PLAN AND PROGRAM FOR THE IMMEDIATE DEMOLITION AND/OR REMOVAL OF SUCH STRUCTURE" WHEREAS, with the completion of the road widening along the National Highway at Tuburan District, the fly over/overpass structure fronting the Pagadian Capitol College has now rendered impractical as it has become an obstruction and a public nuisance considering its position in the road-right-of-way; WHEREAS, as can be observed, the structure's presence now endangers the safety, security and welfare of the public particularly the motorists and passersby including the students of the Pagadian Capitol College, such that the immediate abatement of such structure by demolition and/or removal is urgently necessary to prevent any untoward incident that might occur thereat; WHEREAS, the Department of Public Works and Highways-having the primary responsibility over such structure-is the proper agency that should come up with appropriate plans and programs for its immediate demolition and/or removal, thus requesting the Highway District Engineer of the First Engineering District of Zamboanga del Sur-DPWH for the purpose is most appropriate; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED to declare, as this body hereby declares the unused fly over/overpass structure fronting the Pagadian Capitol College along the national highway at Tuburan District, this City as a public nuisance. RESOLVED FURTHER, to request the Highway District Engineer of the First Engineering District of Zamboanga del Sur-DPWH to come up with an appropriate plan and program for the immediate demolition and/or removal of such structure. RESOLVED, FINALLY, to let copies of this Resolution be furnished the Highway District Engineer, First Engineering District of Zamboanga del Sur-Department of Public Works and Highways, this city, for information and immediate favorable action; and to the Honorable City Mayor, for support and follow-up.
