RESOLUTION NO. 2020-0484 (Sponsored by: Honorable Arnold G. Gavenia) "A RESOLUTION EARNESTLY REQUESTING THE HONORABLE SECRETARY OF THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS (DPWH) TO FAVORABLY CONSIDER THE REDUCTION OF THE NATIONAL HIGHWAY'S SIXTY (60) METER ROAD RIGHT-OF-WAY TO THIRTY (30) METERS PARTICULARLY THE ROAD SEGMENT TRAVERSING THE URBAN AREAS OF THE CITY OF PAGADIAN FROM THE BOUNDARY OF BARANGAY TIGUMA UP TO BOUNDARY OF BARANGAY BALANGASAN" WHEREAS, in line with the national government's policy, the Department of Public Works and Highways (DPWH) is presently implementing massive road widening and concreting along national roads with the end in view of attaining the standard road right-of-way demarcation mark for all national highways pursuant to Executive Order No. 621, series of 1980, which, in gist, established the classification of roads; WHEREAS, Executive Order No. 113, series of 1955, provides that national roads shall have a right of way of not less than twenty (20) meters, provided, that such minimum width may be reduced at the discretion of the Minister of Public Highways to fifteen (15) meters in highly urbanized areas and that a right-of-way of at least sixty (60) meters shall be reserved for roads constructed through unpatented public land and at least one hundred twenty (120) meters reserved through naturally forested areas of aesthetic or scientific value; WHEREAS, while the City Government of Pagadian fully supports the national government's position and policy for the conduct of a massive implementation of road widening and concreting along the national highways, however, after due evaluation and assessment, finds the application of such policy not feasible and impractical along the national highways traversing the urban areas considering that the parcels of lots are privately titled since time immemorial and several commercial buildings and institutions have already been established thereat; WHEREAS, for this reason, it is thus imperatively necessary to seek the intercession of the Secretary of Public Works and Highways for the reduction of the national highway's road right-of-way from 60 meters to 30 meters particularly the road segment traversing the urban areas of the city, hence, this request; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED to earnestly request, as this body hereby earnestly requests the Honorable Secretary of the Department of Public Works and Highways (DPWH) to favorably consider the reduction of the National Highway's Sixty (60) meter road right-of-way to Thirty (30) meters particularly the road segment traversing the urban areas of the City of Pagadian from the boundary of Barangay Tiguma up to boundary of Barangay Balangasan. RESOLVED FURTHER, to let a copy of this Resolution be forwarded to His Honor, Secretary Mark A. Villar, DPWH, Bonifacio St., Port Area, Metro Manila, Philippines, for his information and favorable consideration; to the District Engineer, First Engineering District of Zamboanga del Sur, DPWH; and to His Honor, City Mayor Samuel S.
