RESOLUTION NO. 2020-0464 (Sponsored by: Honorable Arnold R. Gavenia) "A RESOLUTION PROVISIONALLY SUSPENDING THE IMPLEMENTATION OF DELIVERY AND CARGO TRUCK BAN IN THE CITY OF PAGADIAN AS PROVIDED UNDER SECTION 92 OF CITY ORDINANCE NO. 2018-400, ENTITLED: "AN ORDINANCE PROVIDING FOR THE ROAD NETWORK AND TRANSPORTATION MANAGEMENT CODE OF PAGADIAN CITY," AND, THEREBY, RENDERING RESOLUTION NO. 2019-0162, DATED 25 SEPTEMBER 2019, ENTITLED: "A RESOLUTION ADOPTING A SET OF GUIDELINES, RULES AND REGULATIONS GOVERNING THE PARKING OF ALL DELIVERY AND CARGO TRUCKS, INCLUDING TRACTOR TRAILERS OR PRIME MOVERS FOR CONTAINERIZED HAULING SERVICES AND FOR ANY SUCH OTHER PURPOSES, ALONG THE NATIONAL HIGHWAY AND CITY STREETS/ROADS WITHIN THE JURISDICTION OF PAGADIAN CITY," INEFFECTIVE AND UNENFORCEABLE" WHEREAS, to ensure the management of traffic condition in the City of Pagadian, the Sangguniang Panlungsod, in enacting City Ordinance No. 2018-400, entitled: "An Ordinance Providing for the Road Network and Transportation Code of Pagadian City," provides, under Section 92 thereof, the prohibition of delivery trucks, and such other cargo trucks, including tractor trailers or prime movers for containerized hauling services and for any such other purposes or used for parking purposes from 7:00 a.m. to 8:00 p.m. in all segments of the streets and all areas within the perimeter of the following specified roads sections, namely: 1) North - Jose Sanson Street (from Sabado Street up to Serapio J. Datoc Street); 2) East - Fernando Sabado Street (from J. P. Rizal Avenue up to Cabrera Street; 3) West - Serapio J. Datoc Street (from W. Pulmones Street up to Sanson Street); 4) South - Warlito Pulmones Street (from Vicente M. Cerilles Street up to Serapio J. Datoc Street) WHEREAS, along with the foregoing provision, this august body, in its desire to better implement the same, passed Resolution No. 2019-0162, dated 25 September 2019, which, in gist, adopts a Set of Guidelines, Rules and Regulations Governing the Parking of all Delivery and Cargo Trucks, Including Tractor Trailers or Prime Movers for Containerized Hauling Services and For Any Such Other Purposes, Along the National Highway and City Streets/Roads Within the Jurisdiction of Pagadian City;" WHEREAS, given the prevailing situation now where the entire City of Pagadian was placed under Enhanced Community Quarantine due to the Corona Virus Disease 2019 pandemic where several lives have been lost already and infected several hundreds of persons in the country, there is a necessity to ensure the continued availability of essential food commodities thus all delivery and cargo trucks carrying and/or transporting supply of essential goods to the city must remain unhampered and unrestricted to ascertain sufficiency of food supply in the city; WHEREAS, in order to guarantee the free-flow of deliveries of basic food commodities in the city brought by cargo vehicles during this very distressing moment, it is now deemed necessary to provisionally suspend the implementation of Section 92 of City Ordinance No. 2018-400 and render Resolution No. 2019-0162 ineffective and unenforceable; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED to provisionally suspend, as it is hereby provisionally suspended the implementation of delivery and cargo truck ban in the City of Pagadian as provided under Section 92 of City Ordinance No. 2018-400, entitled: "An Ordinance Providing For The Road Network And Transportation Management Code Of Pagadian City," and, thereby, rendering Resolution No. 2019-0162, dated 25 September 2019, entitled: "A Resolution Adopting A Set Of Guidelines, Rules And Regulations Governing The Parking Of All Delivery And Cargo Trucks, Including Tractor Trailers Or Prime Movers For Containerized Hauling Services And For Any Such Other Purposes, Along The National Highway And City Streets/Roads Within The Jurisdiction Of Pagadian City," ineffective and unenforceable. RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co; and to all others concern, for their information and guidance. APPROVED UNANIMOUSLY.
