RESOLUTION NO. 2020-0453 (Sponsor: Committee on Ways and Means) "A RESOLUTION GRANTING EXEMPTION TO THE IMPOSITION OF THREE PERCENT (3%) MONTHLY PENALTY OF THE TOTAL UNPAID MONTHLY AMORTIZATIONS OF THE BO'S CAFE STALL AS WELL AS STALL NOS. 13 AND 15 OF THE BASEMENT FLOOR OF THE CITY COMMERCIAL CENTER (C3) PURSUANT TO THE RECOMMENDATION OF THE CITY COMMERCIAL CENTER BOARD THROUGH ITS RESOLUTION NO. 7, SERIES OF 2019" WHEREAS, the City Commercial Center Board-the policy-making body of the City Commercial Center (C3)-during its Board Meeting held on 10 October 2019, adopted Resolution No. 7 series of 2019 entitled: "A Resolution Strongly Recommending to the Honorable Sangguniang Panlungsod of Pagadian City for the Exemption of the Imposition of 3% Monthly Penalty of the Total Unpaid Monthly Amortizations of Eunice Ong for Bo's Cafe and Mr. Maximo Cascara and Mr. Patrick Wee for Stall Nos. 13 and 15, respectively, situated particularly at the Basement Floor of the City Commercial Center, due to the forcible and illegal foreclosure made during the term of C3 Manager Lauro F. Mendoza", and forwarded the same to this august body's for its appropriate consideration; WHEREAS, the Committee on Ways and Means, which was tasked to initially evaluate and consider the foregoing concern, favorably recommended the grant of an exemption following its findings that the forcible and illegal foreclosure effected by the previous management to the afore-mentioned stalls is unlawful and is bereft of any legal basis, which recommendation merited the support and concurrence of the body; NOW, THEREFORE, on seconded motion of Honorable Troy B. Asugas, be it RESOLVED to grant, as this body hereby grants exemption to the imposition of Three Percent (3%) monthly penalty of the total unpaid monthly amortizations of the Bo's Cafe stall as well as Stall Nos. 13 and 15 of the basement floor of the City Commercial Center (C3) pursuant to the recommendation of the City Commercial Center Board through its Resolution No. 7, series of 2019. RESOLVED, FURTHER, to let copies of this Resolution be furnished His Honor, City Mayor Samuel S. Co, in his concurring capacity as Chairman of the City Commercial Center (C3), for his information, guidance and/or appropriate action; to the C3 Manager; the City Budget Officer; the City Accountant; the City Treasurer; and the City Auditor, for their information, guidance and reference.
