RESOLUTION NO. 2020-0449 (Co-Sponsors: Committee on Public Utilities, Transportation, Communications and Franchising and Committee on Police, Fire and Public Safety) "A RESOLUTION INFORMING THE SANGGUNIANG BAYAN OF LABANGAN, PROVINCE OF ZAMBOANGA DEL SUR, THAT THEIR REQUEST, AS ENUNCIATED IN ITS RESOLUTION NO. 6128-2020, CANNOT BE GIVEN DUE COURSE IN VIEW OF THE DIRECTIVES OF THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT UNDER MEMORANDUM CIRCULAR NO 121-2019 AND MEMORANDUM CIRCULAR NO. 2020-036" WHEREAS, the Office of the City Mayor endorsed to this august body Resolution No. 6128-2020 of the Sangguniang Bayan of Labangan, Province of Zamboanga del Sur, which, in gist, requested the City Government of Pagadian through Honorable City Mayor Samuel S. Co to allow/permit tricycles-for-hire from Labangan to enter the vicinity of Pagadian city and designating parking area thereof, from Labangan original point of destination to Pagadian City proper, vice versa, for its information and appropriate consideration; WHEREAS, the concerned Committees-to which the foregoing matter was referred for initial evaluation and consideration-in its Joint Committee Report No. 144 provided the following findings and observations, to wit: Official Report revealed that-while there has been a growing vehicular population in the city-the illegal entry and the solicitation of passengers by motorized tricycles-for-hire carrying the franchise of the other Local Government Units as well as the proliferation of unauthorized units in the city have greatly contributed to the worsening traffic condition of the city aside from the negative effect it caused to the livelihood and income of legitimate motorized tricycle-for-hire operators and drivers of the city; Memorandum Circular No. 121-2019, dated 29 July 2019, issued by the Department of the Interior and Local Government (DILG), on the subject: "Presidential Directive during the 4th State of the Nation Address (SONA) of the President to clear roads of illegal structures and constructions; Memorandum Circular No. 2020-036, dated 17 February 2020, issued by the Department of the Interior and Local Government (DILG), which, in gist, prohibited tricycles, pedicabs, and motorized pedicabs from operating on national highways; WHEREAS, while this august body empathizes with the predicament, hardship and difficulties of the students as well as other local residents of the Municipality of Labangan to include neighboring municipalities in coming to the City of Pagadian, however, its request cannot be favorably acted upon for reason that it runs counter with the afore-mentioned national directives; NOW, THEREFORE, on seconded motion of Honorable Jesuseller M. Duterte, be it RESOLVED to inform, as this body hereby informs the Sangguniang Bayan of Labangan, Province of Zamboanga del Sur, that their request as enunciated in its Resolution No. 6128-2020 cannot be given due course in view of the directives of the Department of the Interior and Local Government under Memorandum Circular No. 121-2019 and Memorandum Circular No. 2020-036. RESOLVED, FURTHER, to let copies of this Resolution be forwarded to the Sangguniang Bayan of Labangan through Honorable Vice Mayor Marlon B. Valenzuela; and to the Honorable City Mayor, for their information, guidance and/or appropriate action. APPROVED UNANIMOUSLY. I HEREBY CERTIFY to the correctness of the foregoing resolution.
