"A RESOLUTION AUTHORIZING HONORABLE CITY MAYOR SAMUEL S. CO TO ENTER INTO AND SIGN, FOR AND IN BEHALF OF THE CITY GOVERNMENT OF PAGADIAN, THE MEMORANDUM OF AGREEMENT WITH THE NATIONAL HOUSING AUTHORITY, FOR THE IMPLEMENTATION OF HOUSING ASSISTANCE PROGRAM FOR THE INDIGENOUS CULTURAL COMMUNITIES (ICC)/INDIGENOUS PEOPLES IN PAGADIAN CITY"

WHEREAS, in line with the thrust of this present administration to address the housing needs of the city's constituents, the City Government of Pagadian and the National Housing Authority (NHA) have agreed to collaborate in the implementation of the Housing Assistance Program for the Indigenous Peoples of the city particularly in Barangay Lison Valley;
WHEREAS, in relation thereto, the Honorable City Mayor requested that he be accorded the necessary authority to sign for and in behalf of the City Government in the formal forging of the Memorandum of Agreement with the National Housing Authority so as to facilitate the early and successful realization of the program, which request merits the support and concurrence of the body;
NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it
RESOLVED to authorize, as this body hereby authorizes Honorable City Mayor Samuel S. Co to enter into and sign, for and in behalf of the City Government of Pagadian, the Memorandum of Agreement with the National Housing Authority for the implementation of Housing Assistance Program for the Indigenous Cultural Communities (ICC)/Indigenous Peoples in Pagadian City.

RESOLVED, FURTHER, that the City Government of Pagadian commits to undertake the project in accordance with the following guidelines:

To undertake jointly with NHA, IP Community, and National Commission on Indigenous People (NCIP) all aspects of the land development in accordance with the approved plans, specifications, costs, and schedule;

Provide water and power facilities for the project;

Provide funds necessary for the implementation of project components not covered by NHA's assistance;

Create a Project Implementation Team which shall be responsible for the preparations of the project plans, and implementation of the project to include land development and housing construction;


Undertake social preparation activities with NHA and NCIP in compliance to the Free Prior Informed Consent (FPIC) Process pursuant to Section 59 of EPIRA Law and Section 43 on the Validation Process based on Administrative Order No. 3, s. 2012;

Secure all required permits and clearances necessary for the implementation of the project;

Submit all monitoring and project completion reports as required;

Return to NHA any unutilized funds released for the project;

To accept, maintain, and repair the completed infrastructure turned-over by the NHA to the City and to undertake proper use and maintenance of open spaces;

To provide socio-economic facilities and services and/or implement programs for the welfare of the beneficiaries; and

Without need of demand, return the total fund contribution to the NHA should it fail to complete the development works, except in cases of force majeure, within the prescribed period and failure to award the said units to qualified beneficiaries.

RESOLVED, FINALLY, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his information and immediate favorable action; to the City Legal Officer; and to the Regional Manager, National Housing Authority-Regional Office IX, for their information, guidance and/or appropriate action.
