RESOLUTION NO. 2019-0302 (Co-Sponsors: Committee on Good Government, Ethics and Civil Service; Committee on Laws, Rules and Policy Formulation; and Committee on Planning and Landed Estates) "A RESOLUTION REQUESTING THE HONORABLE CITY MAYOR, THIS CITY, TO DIRECT THE PERMITS & LICENSES DIVISION, OFFICE OF THE CITY MAYOR, TO STRICTLY CONSIDER THE PROVISION UNDER SECTION 4.A.1 1.3b, RULE III OF THE IMPLEMENTING RULES AND REGULATIONS (IRR) OF THE HOUSING AND LAND USE REGULATORY BOARD (HLURB) IN THE RENEWAL OF BUSINESS PERMIT TO OPERATE FUNERAL ESTABLISHMENTS IN THE CITY, PARTICULARLY THE PROVISION ON THE HEREUNDER REQUIREMENTS" WHEREAS, this Sanggunian expressed concern and alarm over the complaint filed by a certain Ustadz Ismael Calalagan, President of the Association for Islamic Development (AID), against the operation of a funeral establishment near a Mosque in Barangay Banale, this City, which legal problem, if left unresolved and unacted, could still recur in the near future; WHEREAS, in an effort to preclude such problem to transpire all over again, the body, in support of the recommendation of concerned Committees-to which such matter was referred for prior study-finds it in order to direct the Permits and Licenses Division of the Office of the City Mayor to strictly consider in the renewal of business permit to operate funeral establishments the distance from any of the herein establishments as prescribed under Section 4.A.1 1.3b, Rule III of the Implementing Rules and Regulations (IRR) of the Housing and Land Use Regulatory Board (HLURB); NOW, THEREFORE, on seconded motion of Honorable Vincenzo E. Cagampang, be it RESOLVED to request, as this body hereby requests the Honorable City Mayor, this city, to direct the Permits & Licenses Division, Office of the City Mayor, to strictly consider the provision under section 4.A.1 1.3b, Rule III of the Implementing Rules and Regulations (IRR) of the Housing and Land Use Regulatory Board (HLURB) in the renewal of business permit to operate funeral establishments in the city, particularly the following requirements, to wit: The distance of at least Two Hundred (200) meters from any restaurants, food center and other food establishments; The distance of at least Fifty (50) meters from any Markets; and The distance of at least Two Hundred (200) meters from any Abattoirs, schools and hospitals. RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his preferential consideration and favorable action; to the Chief-Permits and License Division, Office of the City Mayor, for information, guidance and appropriate action; to Ustadz Ismael Calalagan, President, Association for Islamic Development (AID), Banale, this City; and Director Jaime L. Mabilin, Presidential Complaint Center, Office of the President, Malacanang, Manila, for their information, guidance and reference. APPROVED UNANIMOUSLY.
