RESOLUTION NO. 2019-0261 (By Acclamation) "A RESOLUTION EARNESTLY REQUESTING HIS EXCELLENCY, PRESIDENT RODRIGO ROA DUTERTE, THROUGH HONORABLE EXECUTIVE SECRETARY SALVADOR C. MEDIALDEA, TO URGENTLY CONSIDER THE LIFTING OF MEMORANDUM CIRCULAR NO. 11, SERIES OF 2010, AND TO ISSUE COMPULSIVE AND COMPELLING ORDER TO EFFECT THE IMMEDIATE AND COMPLETE TRANSFER OF ALL REGIONAL OFFICES FROM ZAMBOANGA CITY TO PAGADIAN CITY PURSUANT TO EXECUTIVE ORDER NO. 429 AS AMENDED BY EXECUTIVE ORDER NO. 36 WHICH DESIGNATED AND NAMED PAGADIAN CITY AS THE REGIONAL CENTER FOR THE ZAMBOANGA PENINSUAL REGION" WHEREAS, since 1990, Pagadian City was named and designated as the Regional Administrative Center of Region IX or the so-called Zamboanga Peninsula Region by virtue of Executive Order No. 429 issued by the late President Corazon C. Aquino, which Order was declared legal with finality by the Supreme Court en banc last June 22, 1995; WHEREAS, to reinforce and in support of such Order, former President Gloria Macapagal-Arroyo issued Memorandum Circular No. 75, series of 2004, which, in gist, directed all regional offices of all departments to transfer from Zamboanga City to Pagadian City as soon as practicable; WHEREAS, in spite of the apparent and evident mandate conferred to the City of Pagadian as the Regional Center for the Zamboanga Peninsula Region, there are offices, which are opposed to such transfer, which have continuously exerted all efforts and employed various machinations to preempt the full realization of the same and, for which on 22 December 2010, former Executive Secretary Paquito N. Ochoa, Jr., issued Memorandum Circular No. 11, series of 2010, entitled: "Directing a Moratorium on the Transfer of Regional Offices of all Department and Agencies from Zamboanga City to Pagadian City pursuant to Executive Order No. 429, series of 1990;" WHEREAS, such issuance has enjoined all departments, bureaus and other government agencies to temporarily suspend the transfer of their offices in Region 9 to Pagadian City pending the study on the matter and consultations with relevant stakeholders by the Presidential Management Staff (PMS), Department of the Interior and Local Government (DILG), Civil Service Commission (CSC), National Economic Development Authority (NEDA), and the Department of Budget and Management (DBM) and for the said offices to submit, within thirty (30) working days after the issuance of this Memorandum Circular, a comprehensive report of their findings together with their recommendations to the President; WHEREAS, while the people of Pagadian understands the wisdom of the former President in coming up with such issuance, however, it is very unfortunate and deplorable to note that no report were ever made which-to the belief of this august body-was just conceived and concocted to further delay the full transfer of the regional center of the Zamboanga Peninsula Region to Pagadian City, thus greatly caused injustice as it deprived not only the populace of Pagadian City but also the provinces of Zamboanga del Sur, Zamboanga Sibugay and Zamboanga del Norte of the socio-economic benefits and advantages that will be derived therefrom considering Pagadian City is strategically located at the Center of Region 9; WHEREAS, for this reasons, there is now a need to vigorously pursue the actual and meaningful transfer of the Regional Center in the Zamboanga Peninsula Region to Pagadian City, thus, the immediate lifting of the moratorium on the transfer of regional offices of all department and agencies from Zamboanga City to Pagadian City as enunciated under Memorandum Circular No. 11, s. 2010, is imperatively necessary; NOW, THEREFORE, on motion of all Council Members present and severally seconded, it was RESOLVED to earnestly request, as it is hereby earnestly requested His Excellency, President Rodrigo Roa Duterte, through Honorable Executive Secretary Salvador C. Medialdea, to urgently consider the lifting of Memorandum Circular No. 11, series of 2010, and to issue compulsive and compelling Order to effect the immediate and complete transfer of all regional offices from Zamboanga City to Pagadian City pursuant to Executive Order No. 429 as amended by Executive Order No. 36 which designated and named Pagadian City as the Regional Center for the Zamboanga Peninsula Region. RESOLVED, FURTHER, to let copies of this Resolution be furnished His Excellency President Rodrigo Roa Duterte through Honorable Executive Secretary Salvador C. Medialdea, Malacanang, Manila, for immediate favorable consideration; and to His Honor, City Mayor Samuel S. Co, for information, support and follow-up. APPROVED BY ACCLAMATION.
