A RESOLUTION APPROVING THE GRANT OF AMNESTY TO ALL STALL OWNERS OF THE CITY COMMERCIAL CENTER (C3) PARTICULARLY ON THE PAYMENT OF THREE PERCENT (3%) INCURRED FROM UNPAID INSTALLMENTS OF THE SALE OF STALLS AS PRESCRIBED UNDER PARAGRAPH (C), SECTION 1 OF ARTICLE VIII (STANDARD TERMS AND CONDITIONS ON THE SALE OF STALL OF C3), OF CITY ORDINANCE NO. 2009-288, AND PRESCRIBING THE SCHEDULE OF THE AMOUNT OF AMNESTY AND THE PERIOD OF AVAILMENT THEREOF ON A DIMINISHING BALANCE SCHEME

"A RESOLUTION APPROVING THE GRANT OF AMNESTY TO ALL STALL OWNERS OF THE CITY COMMERCIAL CENTER (C3) PARTICULARLY ON THE PAYMENT OF THREE PERCENT (3%) INCURRED FROM UNPAID INSTALLMENTS OF THE SALE OF STALLS AS PRESCRIBED UNDER PARAGRAPH (C), SECTION 1 OF ARTICLE VIII (STANDARD TERMS AND CONDITIONS ON THE SALE OF STALL OF C3), OF CITY ORDINANCE NO. 2009-288, AND PRESCRIBING THE SCHEDULE OF THE AMOUNT OF AMNESTY AND THE PERIOD OF AVAILMENT THEREOF ON A DIMINISHING BALANCE SCHEME"

WHEREAS, the City Commercial Center (C3) Board, by virtue of its Resolution No. 06, series of 2019, recommended the granting of amnesty to all stall owners of the City Commercial Center (C3), particularly on the payment of 3% penalty per month or a fraction of a month in the event the awardee fails to pay on or before the respective due dates and prescribing the schedule of the amount of amnesty and the period of availment thereof on a diminishing balance scheme; 

WHEREAS, the foregoing recommendation was anchored on the fact that, presently, businesses engaged at C3 are still sthriving to prosper as the stall owners thereat find it hard and difficult to sustain and bear the 3% penalty per month on top of the required monthly amortization; 

WHEREAS, Paragraph (a) of Article 107 of the Rules and Regulations Implementing the Local Government Code provides that matters relating to proprietary functions and to private concerns shall be acted upon by resolution, such that this body, having been fully aware that the City Government is exercising its proprietary function when it established and operated the City Commercial Center (C3) as an economic enterprise and, considering that the proposed amnesty will not, in any way, compromise the expected revenues to be derived therefrom, deems it most practicable and reasonable to grant the amnesty and providing the schedule of amnesty and the period of its availment;

NOW, THEREFORE, on seconded motion of Honorable Teodoro M. Quicoy, be it

RESOLVED to approve, as this body hereby approves the grant of amnesty to all stall owners of the City Commercial Center (C3) particularly on the payment of three percent (3%) incurred from unpaid installments of the sale of stalls as prescribed under Paragraph (c), Section 1 of Article VIII (Standard Terms And Conditions On The Sale Of Stall Of C3), of City Ordinance No. 2009-288, and prescribing the schedule of the amount of amnesty and the period of availment thereof on a diminishing balance scheme, to wit:

Upon the date of effectivity of the 
Resolution until December 31, 2019 - 90% reduction from penalty 
January 1, 2020 to February 29, 2020 - 80% reduction from penalty
March 1, 2020 to April 30, 2020 - 60% reduction from penalty
May 1, 2020 to June 30, 2020 - 40% reduction from penalty
July 1, 2020 to August 31, 2020 - 20% reduction from penalty

RESOLVED FURTHER, to let a copy of this Resolution be furnished the Honorable City Mayor, in his concurring capacity as Chairman-C3 Board; the City Treasurer; the City Auditor; the C3 Manager; and the C3 Stall Owners Association through its President, Dr. Jerelyn de Castro, all of this city, for information, guidance and reference.
