RESOLUTION NO. 2019-0176 (Co-Sponsors: Committee on Public Utilities, Transportation, Communications & Franchising; Committee on Laws, Rules & Policy Formulation and Committee on Police, Fire & Public Safety) "A RESOLUTION DECLARING AND APPROVING THE RECLASSIFICATION AS INDUSTRIAL ZONE THE PARCEL OF LAND, COVERED BY TRANSFER CERTIFICATE OF TITLE (TCT) NO. 131-2019000505, LOCATED AT PUROK TALONG, BARANGAY BANALE, THIS CITY, WHICH LAND AREA SHALL BE USED FOR THE DEVELOPMENT, INSTALLATION AND OPERATION OF A SOLAR PHOTOVOLTAIC POWER PLANT AND INTERCONNECTION FACILITIES" WHEREAS, taking into consideration the significant contribution to the socio-economic development of the city once the Solar Photovoltaic (PV) Power Plant is being established and operationalized in the City of Pagadian, the Sangguniang Panlungsod (13th City Council), by virtue of Resolution No. 2019-0175, manifested its strong support and interposes no objection to the application for special land use permit over a parcel of land, covered by Transfer Certificate of Title (TCT) No. 131-2019000505, situated at Purok Talong, Barangay Banale, this city, for the said project; WHEREAS, consequently, in view of the recommendation of the concerned Committees, to which the foregoing matter was initially referred, this body- while being aware that the processing and approval of application for special land use permit is within the ambit of the authority of the Housing and Land Use Regulatory Board (HLURB) where certain documentary requirements has been set by the board for compliance before any plant can be established in an area classified as low density residential area (R-1)- deems it appropriately necessary to declare and approve the reclassification of the area where the project is to be constructed as an Industrial Zone; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED, as this body hereby resolves to declare and approve the reclassification as Industrial Zone the parcel of land, covered by Transfer Certificate of Title (TCT) No. 131-2019000505, located at Purok Talong, Barangay Banale, this City, which land area shall be used for the development, installation and operation of a Solar Photovoltaic (PV) Power Plant and Interconnection Facilities. RESOLVED FURTHER, to let copies of this Resolution be forwarded to the Regional Director, Housing and Land Use Regulatory Board (HLURB), Cagayan de Oro City, for their information, guidance and/or appropriate action; to the City Planning & Development Coordinator; and to the Astronergy Development Pagadian Incorporated, through Mr. Cesario D.
