RESOLUTION NO. 2019-0156 (Sponsor: Committee on Health and Social Services) "A RESOLUTION COMMISSIONING THE COMMITTEE ON PUBLIC UTILITIES, TRANSPORTATION, COMMUNICATIONS & FRANCHISING TO FORMULATE AN APPROPRIATE ORDINANCE THAT SHALL GOVERN THE ESTABLISHMENT OF DEEP WELLS IN THE CITY OF PAGADIAN, INCLUDING OTHER RELATED ACTIVITIES SUCH AS DRILLING AND EXCAVATIONS AS WELL AS DEFINE THE POWERS, FUNCTIONS, DUTIES AND RESPONSIBILITIES OF THE PAGADIAN CITY WATER DISTRICT (PCWD) RELATIVE TO THE APPLICATIONS OF DEEP WELL PERMIT AND ESTABLISH THE PROCEDURES AND SANCTIONS, IF NECESSARY" WHEREAS, it has been the observation of this august body that the National Water Resources Board or NWRB has been furnishing the Office of the Secretary to the Sanggunian with Notices of Water Permit Application of city residents who intend to develop, operate and maintain their own water resources usually situated within their property, with a request for the posting of the said notice and the issuance of a Certification to that effect thereafter; WHEREAS, as a further observation, the foregoing practice of the NWRB is merely to satisfy legal requirements considering that the notices are only received after the scheduled date of hearing and that, seemingly, the same disregards the competence and authority of the local water district to monitor or to determine the propriety and feasibility on the grant of such permit; WHEREAS, in order to remedy the foregoing situation, the Committee on Health and Social Services, to which the foregoing matter was referred for preliminary consideration, recommended to commission the Committees on Public Utilities, Transportation, Communication and Franchising to formulate, by way of an enabling ordinance, such applicable policies and guidelines relative to the development, operation and maintenance of deep wells, which recommendation was duly concurred by the body; NOW, THEREFORE, on seconded motion of Honorable Priscilla M. Fernandez, be it RESOLVED to commission, as this body hereby commissions the Committee on Public Utilities, Transportation, Communications & Franchising to formulate an appropriate Ordinance that shall govern the establishment of deep wells in the City of Pagadian, including other related activities such as drilling and excavations as well as define the powers, functions, duties and responsibilities of the Pagadian City Water District (PCWD) relative to the applications of deep well permit and establish the procedures and sanctions, if necessary. RESOLVED FURTHER, to let copies of this Resolution be furnished His Honor, City Mayor Samuel S. Co, Honorable City Councilor Jesuseller M. Duterte Chairperson of the Committee on Public Utilities, Transportation, Communication & Franchising, for their information, guidance and/or appropriate action. APPROVED UNANIMOUSLY.
