RESOLUTION NO. 2019-0153 (Co - Sponsors: Committee on Ecology; and Committee on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING TO THE BARANGAY COUNCIL OF LENIENZA ITS BARANGAY ORDINANCE NO. 2019-01, WITHOUT ACTION, WITH A FURTHER ADVICE TO DELETE SECTIONS 18 AND 20 THEREOF AND MODIFY THE PENALTIES PROVIDED THEREAT TO CONFORM TO THE POWER OF THE SANGGUNIANG BARANGAY AS PROVIDED UNDER THE LOCAL GOVERNMENT CODE OF 1991" WHEREAS, Barangay Ordinance No. 2019-01, of Lenienza was transmitted to this body for review as required under the Local Government Code of 1991; WHEREAS, the Committee on Ecology and Committee on Laws, Rules & Policy Formulation, to which the matter was jointly referred for preliminary evaluation, found that Sections 18 and 20 of the said Barangay Ordinance need to be deleted for the reason that such provisions are no longer within the ambit of the power of the Sangguniang Barangay as embodied in the Local Government Code of 1991, as well as the modification of the prescribed penalties provided thereat, thus its recommendation to remand the same to the concerned barangay was supported by the body; NOW, THEREFORE, on seconded motion of Honorable Jesuseller M. Duterte, be it RESOLVED to remand, as this body hereby remands to the Barangay Council of Lenienza its Barangay Ordinance No. 2019-01, without action, with a further advice to delete sections 18 and 20 thereof and modify the penalties provided thereat to conform to the power of the Sangguniang Barangay as provided under the Local Government Code of 1991. RESOLVED FURTHER, to let copies of this Resolution be transmitted to the Barangay Council of Lenienza, this City, for its information and guidance APPROVED UNANIMOUSLY.
