RESOLUTION NO. 2019-0147 (Co - Sponsors: Committee on Infrastructure, Public Bidding and Community Development; Committee on Agriculture, Fishery and Agrarian Reform and Committee on Ways and Means) "A RESOLUTION DECLARING AS CITY GOVERNMENT RESERVED AREA ALL PARCELS OF LANDS WITHIN THE FIVE HUNDRED (500) METERS CIRCUMFERENCE FROM THE BOUNDARIES OF THE PRESIDENT CORAZON C. AQUINO REGIONAL CENTER SITE AT BARANGAY BALINTAWAK, THIS CITY, PURPOSELY FOR USE IN THE EXPANSION OF SUCH REGIONAL CENTER SITE AND, THEREBY, IN EFFECT, PROHIBITING ALL CONCERNED REGISTERED LANDOWNERS FROM CONSTRUCTING RESIDENTIAL HOUSES AND OTHER STRUCTURES THEREAT AS WELL AS SELLING/DISPOSING THE SAME" WHEREAS, together with the City Government's ardent desire and continuing effort to implement the full transfer of all regional offices in Region 9 to Pagadian City, is the requirement to provide, install and establish the needed facilities and amenities to ascertain and hasten the regional offices' relocation to the city; WHEREAS, knowing that the lot area available for donation to the transferring regional offices in the President Corazon C. Aquino Regional Center site at Barangay Balintawak, this City, is almost exhausted, the need for the city government to acquire additional parcels of lands for use in the expansion of such regional center site is no longer uncertain and far-fetched; WHEREAS, momentarily-while the total land area requirement for expansion is still being determined-this body, based on the recommendation of the concerned Committees, to which the foregoing matter was referred for initial evaluation and consideration, finds no legal impediment to prohibit landowners within the 500 meters circumference from the boundaries of the present regional center site at Barangay Balintawak, to build/construct residential houses or other structures as well as to sell/dispose the same as it considers such area as city government reserved area; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED to declare, as this body hereby declares as City Government reserved area, all parcels of lands within the Five Hundred (500) meters circumference from the boundaries of the President Corazon C. Aquino Regional Center site at Barangay Balintawak, this city, purposely for use in the expansion of such regional center site and, thereby, in effect, prohibiting all landowners from constructing residential houses and other structures thereat as well as selling/disposing the same. RESOLVED FURTHER, to let copies of this Resolution be furnished the Honorable City Mayor, the City Assessor, the City Register of Deeds, the City Planning and Development Officer and the Barangay Government of Balintawak for their information, guidance and/or appropriate action.
