RESOLUTION NO. 2019-0113 (Sponsor: Committee on Games, Amusements and Sports) "A RESOLUTION ADVISING THE 54 BARANGAY GOVERNMENT UNITS OF THE CITY OF PAGADIAN, THROUGH THE HONORABLE CITY MAYOR, TO CEASE AND DESIST FROM CONSIDERING AND/OR APPROVING THE APPLICATION OF GLOBALTECH MOBILE ONLINE CORPORATION TO OPERATE IN THE CITY FOR THE REASONS HEREIN STIPULATED" WHEREAS, the Sangguniang Barangay of Lumbia, through its Resolution No. 2008-19-06, requested assistance from the Sangguniang Panlungsod relative to the legality of the operation of Globaltech Mobile Online Corporation Outlets operating in some parts of Barangay Lumbia; WHEREAS, the body, in consideration of the information provided by the Committee on Games, Amusements and Sports, to which the foregoing matter was initially referred, that the authority/license of Globaltech Mobile Online Corporation to operate had already been terminated by the Philippine Charity Sweepstakes Office (PCSO) since March 31, 2016, deems it most prudent to advise all barangay government units of the city to stop, if not prohibit, the operation of the afore-mentioned company, if there are any, pending further legal notice or order to the contrary; NOW, THEREFORE, on seconded motion of Honorable Sam Tyra F. Co, be it RESOLVED to advise, as this body hereby advises the 54 Barangay Government Units of the City of Pagadian, through the Honorable City Mayor, to cease and desist from considering and/or approving the application of Globaltech Mobile Online Corporation to operate in the city for the following reasons, to wit: That the continued establishment and operation of Globaltech Mobile Online Corporation is now considered unauthorized and illegal as their license/authority to operate had already been terminated since March 31, 2019, based on the letter from Mr. Miro Regondola, PCSO Branch Manager as endorsed by the Department of the Interior and Local Government; That the Status Quo Ante Order issued by the Court of Appeals in favor of the said corporation cannot not be invoked considering that they have failed to comply and submit the pertinent documents necessary for evaluation by the PCSO. RESOLVED FURTHER, that this Resolution be forwarded to the 54 Barangay Council of the City of Pagadian through their respective Punong Barangays, for information, guidance and/or appropriate action; to the Chief of Police-Pagadian City Police Station, for information, guidance and/or appropriate action; and to the Honorable City Mayor, for support and dissemination.
