RESOLUTION NO. 2019-0103 (Co-Sponsors: Committee on Ways and Means and Committee on Infrastructure, Public Bidding and Community Development) "A RESOLUTION APPROVING THE MODIFICATION TO THE PROVISIONS IN THE CONTRACT OF LEASE, PARTICULARLY ITEM NO. 3 THEREOF, ENTERED INTO BY AND BETWEEN THE CITY GOVERNMENT OF PAGADIAN AND THE DEPARTMENT OF AGRARIAN REFORM (DAR)-PROVINCIAL OFFICE ON THE MATTER OF THE AMOUNT OF LEASE OF THE CITY GOVERNMENT-OWNED BUILDING FROM NINETY THOUSAND SEVEN HUNDRED EIGHTY AND 98/100 (P90,780.98) PESOS TO EIGHTY THOUSAND (P80,000.00) PESOS, AND AUTHORIZING THE HONORABLE CITY MAYOR TO ENTER AND SIGN THE CONTRACT OF LEASE AS MODIFIED/AMENDED, WHICH CONTRACT SHALL BE SUBJECT TO THE CONFIRMATION OF THE SANGGUNIANG PANLUNGSOD" WHEREAS, the provincial office of the Department of Agrarian Reform (DAR) ), for quite some time now, had been leasing the city government-owned building at the Pagadian City Sports Complex in the amount of P90,780.98 per month; WHEREAS, very recently, the said agency through its Provincial Agrarian Reform Program Officer II, by way of a letter, requested the City Government to adjust and fixed the monthly rental in the amount of P80,000.00 considering that the building is already dilapidated and due for repair and rehabilitation, which letter-request was endorsed by the Honorable City Mayor for this body's consideration; WHEREAS, the concerned Committees-to which the foregoing matter was jointly referred, and following its assessment and evaluation of the request vis-a-vis the unfavorable condition of the building, recommended the grant of authority to the City Chief Executive for the modification of the Contract of Lease as requested, which recommendation merited the concurrence and approval of the body; NOW, THEREFORE, on seconded motion of Honorable Troy B. Asugas, be it RESOLVED to approve, as this body hereby approves the modification to the provisions in the Contract of Lease, particularly Item No. 3 thereof, entered into by and between the City Government of Pagadian and the Department of Agrarian Reform (DAR)-Provincial Office on the matter of the amount of lease of the City Government-owned building from Ninety Thousand Seven Hundred Eighty and 98/100 (P90,780.98) Pesos to Eighty Thousand (P80,000.00) Pesos, and authorizing the Honorable City Mayor to enter and sign the Contract of Lease as modified/amended, which contract shall be subject to the confirmation of the Sangguniang Panlungsod. RESOLVED FURTHER, to let copies of this Resolution be furnished His Honor, City Mayor Samuel S. Co, for his appropriate action; the City Legal Officer; and the Department of Agrarian Reform-Provincial Office, through Atty. Judith P. Mantos, PARPO II, for its information and reference.
