RESOLUTION NO. 2019-0097 (Sponsor: Honorable Teodoro M. Quicoy) "A RESOLUTION INFORMING THE HEIRS OF THE LATE JOSE SUMAMPONG REPRESENTED BY MR. DIONESIO B. SUMAMPONG AND MR. EMILLIANO B. SUMAMPONG THAT THEIR CLAIM CONTESTING THE CITY GOVERNMENT'S ACQUISITION OVER A PARCEL OF LAND KNOWN AS PORTION OF LOT 5856-E PSD-82440, CONTAINING AN AREA OF SEVENTEEN THOUSAND FOUR HUNDRED SEVENTY-FOUR (17,474) SQUARE METERS, SITUATED AT PUROK NAZARETH, BARANGAY BUENAVISTA, THIS CITY, CANNOT BE GIVEN DUE CONSIDERATION BY THE SANGGUNIANG PANLUNGSOD AS THE CITY GOVERNMENT IS AFFIRMING THE LEGITIMACY AND VALIDITY OF THE DEED OF SALE AND THAT THEIR CONCERN CAN ONLY BE PROPERLY VENTILATED IN THE PROPER COURT OF LAW" WHEREAS, Mr. Dionesio B. Sumampong and Mr. Emilliano B. Sumampong, the heirs of the late Jose Sumampong, by way of a sworn letter-complaint, alleged that the City Government, during the incumbency of the late City Mayor Benjamin F. Arao, has acquired through sale a parcel of land known as portion of Lot 5856-E, Psd-82440, registered in the name of Jose Sumampong, and containing an area of Seventeen Thousand Four Hundred Seventy-Four (17,474) square meters, located at Purok Nazareth, Barangay Buenavista, this City; WHEREAS, further into the allegations revealed that the Contract of Sale entered into by and between the City Government and the alleged registered owner, Jose Sumampong, was questionable and dubious as, accordingly, the lot owner had long been dead since the contract of sale was entered and perfected by the supposed parties concerned, thus, a claim for amicable settlement with the City Government was brought before this body; WHEREAS, upon thorough deliberation, this august body-though it does not understate the seriousness of the claim however-deems it appropriately necessary for the City Government to expressly affirm and assert the legitimacy and validity of such Contract of Sale, thus informing the claimants of the Sanggunian's position is in order; NOW, THEREFORE, on seconded motion of Honorable Teodoro M. Quicoy, be it RESOLVED to inform, as this body hereby informs the heirs of the late Jose Sumampong represented by Mr. Dionesio B. Sumampong and Mr. Emilliano B. Sumampong that their claim contesting the City Government's acquisition over a parcel of land known as portion of Lot 5856-E Psd-82440, containing an area of Seventeen Thousand Four Hundred Seventy-Four (17,474) square meters, situated at Purok Nazareth, Barangay Buenavista, this City, cannot be given due consideration by the Sangguniang Panlungsod as the City Government is affirming and asserting the legitimacy and validity of the Deed of Sale and that their concern can only be properly ventilated in the proper court of law. RESOLVED FURTHER, to let copies of this Resolution be transmitted to Mr. Dionesio B. Sumampong and Mr. Emilliano B. Sumampong, both of this City, for information; to His Honor, City Mayor Samuel S.
